ORDINANCE NO. 2013 -48 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, INCREASING RATES ESTABLISHED UNDER <br />SECTION 86.505 OF THE SAN MARCOS CODE FOR DRAINAGE <br />CHARGES; AND INCLUDING PROCEDURAL PROVISIONS <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The drainage charge rates established under Section 86.505 of the San Marcos <br />City Code are hereby set for the fiscal year 2014 begimiing on October 1, 2013 and ending on September <br />30, 2014 as shown on the attached Exhibit A, which is made a part of this ordinance for all purposes. <br />SECTION 2. The drainage charge rates in Exhibit A shall be adjusted by an additional 5% for <br />the fiscal year beginning on October 1, 2014 and ending on September 30, 2015 and an adjusted by an <br />additional 5% for the fiscal year beginning on October 2, 2015 and ending on September 30, 2016 as <br />shown in Exhibit A. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will <br />continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict with <br />this ordinance are repealed. <br />SECTION 5. This Ordinance will take effect ten days after the date of its final passage, and it <br />will apply to all utility bills issued on and after October 1, 2013.
