ORDINANCE NO. 2013 -48 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, INCREASING RATES ESTABLISHED UNDER SECTION 86.505 OF THE SAN MARCOS CODE FOR DRAINAGE CHARGES; AND INCLUDING PROCEDURAL PROVISIONS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The drainage charge rates established under Section 86.505 of the San Marcos City Code are hereby set for the fiscal year 2014 begimiing on October 1, 2013 and ending on September 30, 2014 as shown on the attached Exhibit A, which is made a part of this ordinance for all purposes. SECTION 2. The drainage charge rates in Exhibit A shall be adjusted by an additional 5% for the fiscal year beginning on October 1, 2014 and ending on September 30, 2015 and an adjusted by an additional 5% for the fiscal year beginning on October 2, 2015 and ending on September 30, 2016 as shown in Exhibit A. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. This Ordinance will take effect ten days after the date of its final passage, and it will apply to all utility bills issued on and after October 1, 2013. The City Clerk will publish notice of its adoption in a newspaper of general circulation in the City. PASSED AND APPROVED on first reading on September 3, 2013.
