However, in the event of conflict, dispute, or discrepancy between the provisions of this Agreement and the construction contract documents, the more restrictive and/or burdensome provisions shall govern and control. ARTICLE 12 BASIS OF COMPENSATION The OWNER shall compensate the ARCHITECT for the Scope of Services provided, in accordance with Article 4, Payments to the ARCHITECT, and the other terms and conditions of this Agreement, as follows: $1,510.00. (One Thousand Five Hundred Ten Dollars and No/Cents) 12.1 COMPENSATION FOR ADDITIONAL SERVICES 12 . 1. 1 For Additional Services of the ARCHITECT, as described in Paragraph 1.5, compensation shall be computed as follows: Principal's time at the fixed rate of forty-eight dollars ($48.00) per hour. For the purposes of this Agreement, the Principals are: Jeffrey H. Kester. Designer's, Specifier's and Senior Draftsmen's time at the fixed rate of twenty-eight dollars ($28.00) per hour. For the purposes of this Agreement, the Designers, Specifiers and Senior Draftsmen include: Richard Mersiovsky. Junior Draftsmen's and clerical time at the fixed rate of twenty dollars ($20.00) per hour. For the purposes of this Agreement, the Junior Draftsmen and clerical personnel include: B.J. Spencer. 12.2.2 No payment shall be made by OWNER to ARCHITECT for Additional services of Consultants, incl uding additional structural, mechanical and electrical engineering services. 12.3 Reimbursable Expenses shall be allowed as a part of this Agreement as provided in Article 3 herein. 12.4 OWNER and ARCHITECT agree in accordance with the terms and conditions of this Agreement that: -11-
