<br />82 <br /> <br />This AGREEMENT is made this the <br /> <br />25 <br /> <br />day of <br /> <br />January <br /> <br />19 <br /> <br />88, between the CITY OF SAN MARCOS, TEXAS, hereinafter referred to <br /> <br />as "OWNER", 630 East Hopkins, San Marcos, Texas 78666, and JEFFREY H. <br /> <br />KESTER, <br /> <br />hereinafter <br /> <br />referred <br /> <br />to <br /> <br />as <br /> <br />"ARCHITECT", <br /> <br />for architectural <br /> <br />services in connection with the remodelling of the Municipal Court area <br />at the police department building. <br /> <br />WITNESSETH: <br /> <br />OWNER and ARCHITECT do hereby agree as follows: <br /> <br />ARTI CLE 1. <br /> <br />ARCHITECT' S SERVI CBS AHD RES PONS IBILITIBS <br /> <br />ARCHITECT <br /> <br />shall <br /> <br />be <br /> <br />responsible <br /> <br />for the proper, <br /> <br />accurate <br /> <br />and <br /> <br />adequate <br /> <br />design <br /> <br />in <br /> <br />connection with the hereinabove <br /> <br />mentioned <br /> <br />remodelling project, as well as the preparation of accurate and <br />adequate plans, and technical specifications for the remodeling of <br /> <br />Municipal Court area at the Police Department building, and any <br /> <br />provisions <br /> <br />in <br /> <br />this <br /> <br />Agreement <br /> <br />pertaining <br /> <br />to <br /> <br />OWNER's <br /> <br />review, <br /> <br />approval and/or acceptance of plans, <br /> <br />specifications, <br /> <br />or other <br /> <br />written <br /> <br />materials <br /> <br />prepared <br /> <br />by <br /> <br />ARCHITECT <br /> <br />or <br /> <br />his <br /> <br />consultants, <br /> <br />contractors, and subcontractors in connection with this project(s) <br /> <br />shall <br /> <br />not <br /> <br />be <br /> <br />deemed <br /> <br />to <br /> <br />diminish <br /> <br />ARCHITECT's <br /> <br />responsibility <br /> <br />therefor. <br /> <br />The ARCHITECT's Basic Services consist of the following <br /> <br />phases described in Paragraphs 1. 1 through 1.4, <br /> <br />incl uding the <br /> <br />limited structural, mechanical, <br /> <br />and electrical changes normally <br /> <br />provided by architects in renovation projects. <br /> <br />0.1. <br /> <br />STANDARDS OF PERFORIIAHCB <br /> <br />0.1.1 <br /> <br />In <br /> <br />the <br /> <br />performance <br /> <br />of <br /> <br />all <br /> <br />architectural <br /> <br />services <br /> <br />in <br /> <br />connection with this Agreement, the ARCHITECT shall use that degree of <br />care and skill ordinarily exercised for similar proj ects by large, <br /> <br />national architecting firms. <br /> <br />1.1 <br /> <br />DESIGN DEVBLOPJÅ’HT PHASE <br /> <br />1.1.1 <br /> <br />Based <br /> <br />on <br /> <br />the <br /> <br />information <br /> <br />provided <br /> <br />by <br /> <br />City, <br /> <br />and <br /> <br />any <br /> <br />adjustments authorized by the OWNER in the program or Project budget, <br /> <br />and ARCHITECT's survey of existing conditions, <br /> <br />the ARCHITECT shall <br /> <br />prepare, <br /> <br />for review and approval by the OWNER, <br /> <br />Design Development <br /> <br />Documents consisting of drawings and other documents to fix and <br /> <br />-1- <br />
