<br />13 <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting April 9, 1984 Page 2 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WEICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY ZONING 6.01 ACRES, MORE OR LESS, <br />OF LAND AREA IN THE J. M. VERA!v1ENDI LEAGUE NO.2, HAYS <br />COUNTY, TEXAS, BEING A PORTION OF THAT 9.783 ACRE TRACT <br />OF LAND CONVEYED TO L. O. BACKUS BY QUAD THEATRE COM- <br />PANY, A TEXAS CORPORATION, BY DEED DATED JANUARY 15, <br />1979, AND RECORDED IN VOLUME 321, PAGE 95, HAYS COUNTY <br />DEED RECORDS, A/K/A THE NORTHWEST CORNER OF HIGHWAY 80 <br />AND RIVER ROAD FROM "AO" (AGRICULTURAL-OPEN SPACE DIS- <br />TRICT) TO "LI" (LIGHT INDUSTRIAL DISTRICT). <br /> <br />Mayor Craddock asked if anyone wished to speak in favor of the zoning <br />request and no one did. Mayor Craddock asked if anyone wished to speak <br />in opposition to the request and no one did, so she closed the public <br />hearing. Mr. Guerra moved to approve the Ordinance on first reading <br />and Mayor Craddock seconded the motion. City Attorney Hankins point- <br />ed out the zoning request did not conform to the Master Plan Land Use <br />Map. The request is for "LI" zoning and the Master Plan designate~ <br />"c" for this area, and a Master Plan amendment would be needed. Mayor <br />Craddock moved to table the zoning request until such time as the land <br />use map is amended and Ms. Kissler seconded the motion, which passed <br />unanimously. * <br /> <br />Mayor Craddock opened a public hearing to consider approval of a Zon- <br />ing Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 1.95 <br />ACRES OF LAND AREA OUT OF THE J. M. VERA!v1ENDI LEAGUE <br />NO.2, BEING A PORTION OF THAT CERTAIN TRACT OF LAND <br />IN A DEED TO ROBERT J. JENKINS RECORDED IN VOLUME 83, <br />PAGE 317 OF THE HAYS COUNTY DEED RECORDS, SAME ALSO <br />BEING A PORTION OF THAT CERTAIN TRACT OF LAND REFERRED <br />TO IN CAUSE NO. 3591, PROBATE RECORDS OF HAYS COUNTY, <br />TEXAS, IN FAVOR OF JACK HERMAN WELGE, A/K/A 1615 AQUA- <br />RENA SPRINGS DRIVE, FROM "R-l" (SINGLE-FAMILY DWELLING <br />DISTRICT) TO "D" (MULTI-FAMILY DWELLING DISTRICT). <br /> <br />Mayor Craddock asked if anyone wished to speak in favor of the zoning <br />request. Patsy Greiner was present representing Wooten Investments <br />and stated the zoning change conforms to the Master Plan. No one <br />else wished to speak in favor or in opposition to the zoning change, <br />so Mayor Craddock closed the public hearing. Mr. Farr moved for ap- <br />proval of the Ordinance on first reading and Mr. Guerra seconded the <br />motion. On roll call the following vote was recorded: <br /> <br />AYE: Brown, Farr, Craddock, Guerra, Kissler. <br /> <br />NAY: Coddington, Moore. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Craddock introduced for consideration the adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />* Mr. Moore was present to vote on this matter. <br />
