<br />15 <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting April 9, 1984 Page 4 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />~ffiRCOS, TEXAS, DECLARING A SIXTY-FIVE (65) DAY BUILD- <br />ING MORATORIUM FOR MULTI-FA!v1ILY DWELLINGS IN THE <br />PLANNING UNITS 1, 2, 3, 4, 10 AND 17, DECLARING A <br />SIXTY-FIVE (65) DAY GENERAL BUILDING MORATORIUM ON <br />ALL MULTI-FA!v1ILY PROJECTS OF TWENTY-FIVE UNITS OR <br />MORE, AND DECLARING A SIXTY-FIVE (65) DAY BUILDING <br />MORATORIUM ON ALL PARCELS OF LAND NOT ZONED IN CON- <br />FORMANCE WITH THE CITY'S MASTER PLAN, DECLARING AN <br />EMERGENCY AND PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />Mayor Craddock moved for adoption of the Ordinance on emergency and <br />Mr. Moore seconded the motion. Mr. Moore moved to amend the Ordinance <br />in Section 2 as follows, " . . . no building permits for multi-family <br />residential construction projects of twenty units or more. . . ". <br />Mr. Brown seconded the motion, which passed unanimously. <br /> <br />City Attorney Hankins suggested the following amendments be adopted <br />by the Council, to include three new sections as follows: <br /> <br />"Section 4. That during the sixty-five (65) day periods of building <br />permit moratoria prescribed in this Ordinance, all time limits per- <br />taining to the said building permit process and the site development <br />permit process, be, and they are hereby, suspended, and no further pro- <br />cessing of building permits and site development permits, shall be done <br />by staff during the prescribed moratoria periods." <br /> <br />"Section 5. That during the sixty-five (65) day periods of building <br />permit moratoria prescribed in this Ordinance, the City Manager shall <br />prepare a detailed report of the matters raised in this Ordinance and <br />its preamble and submit such report to the City Council no later than <br />June 4, 1984." <br /> <br />"Section 6. That any'building permit issued prior to the effective date <br />of this Ordinance, pertaining to the areas or restrictions enumerated in <br />Sections 1, 2 or 3 of this Ordinance, is hereby revoked, and any monies <br />paid for and under said permit are ordered returned to the permittee <br />without unreasonable delay, provided that no material or substantial <br />amount of construction has commenced under said permit as of the effect- <br />ive date of this Ordinance." <br /> <br />Also due to these amendments, the caption of the Ordinance would need <br />to be amended to read as follows: <br /> <br />"AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, DECLARING A SIXTY-FIVE DAY BUILDING <br />MORATORIUM FOR MULTI-FAMILY DWELLINGS IN THE PLANNING <br />UNITS 1, 2, 3, 4, 10 AND 17, DECLARING A SIXTY-FIVE <br />(65) DAY GENERAL BUILDING MORATORIUM ON ALL MULTI- <br />FAMILY PROJECTS OF TWENTY UNITS OR MORE, DECLARING A <br />SIXTY-FIVE (65) DAY BUILDING MORATORIUM ON ALL PARCELS <br />OF LAND NOT ZONED IN CONFORMANCE WITH THE CITY'S MASTER <br />PLAN, PROVIDING FOR THE REVOCATION OF CERTAIN BUILDING <br />PERMITS, SUSPENDING THE BUILDING AND SITE DEVELOPMENT <br />PEID1IT PROCESS, DIRECTING THE CITY MANAGER TO PREPARE <br />A REPORT BY JUNE 4, 1984, DECLARING AN EMERGENCY AND <br />PROVIDING FOR AN EFFECTIVE DATE." <br /> <br />Mayor Craddock moved to amend the Ordinance to include Mr. Hankins' <br />suggested amendments and Mr. Moore seconded the motion. The City Secre- <br />tary read the amendments in their entirety into the record. The Council <br />voted unanimous approval of the amendments. <br />
