Rather than attempt to anticipate what <br />actions the legislature may take in the future, the Charter Review <br />Commission believes that a specific date should not be designated <br />in the Charter but, rather, a reference to the uniform election <br />dates should be included as recommended. <br /> <br />12. Sec. 8.17, Purchase procedure, should be amended to delete the <br />specific dollar amounts contained in the provision and <br />substitute the following phrase for those dollar provisions: <br /> <br />"...The Council may by ordinance convey upon the City Manager <br />general authority to contract for expenditures without further <br />approval of the Council for all budgeted items not exceeding F~v-e <br />~lTea&a&4-ge~~aF&-~~~~~~r~~~ the maximum allowed bv State law. <br />All contracts for expenditures involving more than Fiv-e-~~otl~a-n-d <br />9&~~aF&-~~~~~r~~~ the maximum allowed by State law shall be let to <br />the lowest and best responsible bidder after there has been <br />opportunity for competitive bidding as provided for by law or <br />ordinance; provided that the City shall have the right to reject <br />any and all bids...." <br /> <br />JUSTIFICATION: <br /> <br />The legislature has changed the State law dealing with limitations <br />on purchases by cities. The changes suggested above by the Charter <br />Review Commission will eliminate the continuous changing of the <br />City Charter each time the legislature makes a change but the <br />recommendation does not reduce in any way the power and control <br />over such purchases by the City Council. This provision only <br />allows the City Council more flexibility in dealing with <br />purchases through the City Manager. <br /> <br />13. Sec. 10.08, Tax remissions, discounts, and compromises, <br />amended as indicated by following underlined phrase: <br /> <br />should <br /> <br />be <br /> <br />"The City Councilor any other official of the City shall never <br />extend the time for the payment of taxes or remit, discount or <br />compromise any tax legally due the City or waive the penalty and <br />interest that may be due thereon to any persons, firms or <br />
