JUSTI FI CATION: During the last year the Legislature made two different changes in the spring election date. Rather than attempt to anticipate what actions the legislature may take in the future, the Charter Review Commission believes that a specific date should not be designated in the Charter but, rather, a reference to the uniform election dates should be included as recommended. 12. Sec. 8.17, Purchase procedure, should be amended to delete the specific dollar amounts contained in the provision and substitute the following phrase for those dollar provisions: "...The Council may by ordinance convey upon the City Manager general authority to contract for expenditures without further approval of the Council for all budgeted items not exceeding F~v-e ~lTea&a&4-ge~~aF&-~~~~~~r~~~ the maximum allowed bv State law. All contracts for expenditures involving more than Fiv-e-~~otl~a-n-d 9&~~aF&-~~~~~r~~~ the maximum allowed by State law shall be let to the lowest and best responsible bidder after there has been opportunity for competitive bidding as provided for by law or ordinance; provided that the City shall have the right to reject any and all bids...." JUSTIFICATION: The legislature has changed the State law dealing with limitations on purchases by cities. The changes suggested above by the Charter Review Commission will eliminate the continuous changing of the City Charter each time the legislature makes a change but the recommendation does not reduce in any way the power and control over such purchases by the City Council. This provision only allows the City Council more flexibility in dealing with purchases through the City Manager. 13. Sec. 10.08, Tax remissions, discounts, and compromises, amended as indicated by following underlined phrase: should be "The City Councilor any other official of the City shall never extend the time for the payment of taxes or remit, discount or compromise any tax legally due the City or waive the penalty and interest that may be due thereon to any persons, firms or
