<br />-2- <br /> <br />Written permission from the owner of any restroom facility <br />to allow use of the restrooms facilities shall be submitted <br />to the Chief Building Official along with a site plan of <br />the Food Service Facility on the land before a temporary <br />certificate of occupancy may be issued. <br /> <br />(k) shall be <br />property. <br /> <br />franchised by <br /> <br />the <br /> <br />City if <br /> <br />loca ted <br /> <br />on <br /> <br />public <br /> <br />(1) shall pay an administrative fee of $50.00 per certificate. <br /> <br />Sec. 5 1/2-4. <br /> <br />Exemption. <br /> <br />Food booths in conjunction with outdoor events of <br />specified durations such as carnivals, Chilympiad, Mardi <br />Gras, farmer's markets, etc. are exempted from the provisions <br />of this ordinance. <br /> <br />Sec. 5 1/2-5. <br /> <br />Enforcement. <br /> <br />The failure to follow any of the requirements of this Chapter <br />or to comply with any of its provisions shall be a misdemeanor <br />and shall be punishable by a fine not to exceed $500.00. Each <br />day of violation is a separate offense. <br /> <br />Sec. 5 1/2-6. <br /> <br />Effective date for existing facilities. <br /> <br />Any mobile or temporary food service facility engaging in <br />legal operations on the effective date of this ordinance shall <br />have thirty (30) days from the effective date to comply with <br />the terms of this ordinance. <br /> <br />PART 2. That the importance of this Ordinance creates an <br />emergency and an imperative public necessity so that the provisions of <br />the Charter requiring that ordinances shall be presented at three <br />separate meetings and that no ordinance shall become effective until <br />the expiration of ten (10) days following the date of its final passage <br />be suspended, and these provisions are hereby suspended, and this <br />Ordinance shall take effect and be in full force and effect from and <br />after its adoption and after its publication in a newspaper of <br />general circulation within the City as provided by the City Charter of <br />the City of San Marcos, Texas. <br /> <br />PASSED, APPROVED AND ADOPTED this <br /> <br /> <br />day of <br /> <br />April <br /> <br />, 1988. <br /> <br />~~¿r~ <br /> <br />~fni~ K.
