<br />STATE DEPARl'MBNr OF HIœwAYS <br />AND PUBLIC TlWSPORrATION <br /> <br />HAYS <br /> <br />County <br /> <br />MINt1Œ OR>ER <br /> <br />Page <br /> <br />1 of <br /> <br />2 Pages <br /> <br />District No. AUSTIN (14) <br /> <br />~REAS, in HAYS a:xJNl'Y on LOOP 82 in the City of San Marcos, <br />fran Interstate Highway 35 to Bugg Lane, a distance of approximately <br />1.1 miles, Minute Order 81169 dated August 25, 1983 authorized this <br />reconstruction project at an estimated cost of $560,000 to be funded <br />from the 1983-1986 Urban System Program; and <br /> <br />mERFAS, during the preliminary engin~r ing phase of this <br />pcoject, it was determined that it would be necessary ~ construct a <br />continuous left turn lane due to deve1opnent in the area and that right <br />of way would be required for this improvement, and <br /> <br />WHERF.M, the City of San Marcos has offered to provide one <br />hundred percent of the cost of the right of way; <br /> <br />NGl, Tm:REFORE, IT IS ORDERED that the Engineer-Director is <br />directed to tender the following proposal to the City of San Marcos: <br /> <br />provided the City will: <br /> <br />1. Provide one hundred percent of the cost of the right of way <br />clear of obstructions and free of cost to the State with <br />acquisition procedures to be in accordance with ¡:olicies of <br />the State Department of Highways and Public Transp::>rtation <br />and with applicable redera1 and State laws governing the <br />acquisition policies for acquiring real ptoperty. <br /> <br />2. Maintain that ¡:ortion of the work which is its <br />responsibility in accordance with present maintenance <br />agreements. <br />
