City of San Marcos -3- April 5, 1988 to tie down agreements that no member of AWC will contest this provision of San Marcos' contract with LCRA. In any event, the Public utility commission or its staff can always raise the issue in any LCRA wholesale rate proceeding. It was our opinion, and ramains our opinion, that the provision is legal and binding. Finally, we will make our best efforts to work out a cost share arrangement between the Kerrville Public utility Board and San Marcos; we will share issues with the AWC and support A. C. Gonzalez' efforts to credit whatever payments are made to our Firm towards San Marcos' pro rata share of AWC's expenses. Any deadlines imposed by the City which would require the use of secretarial or word processing support staff on weekends or times other than regular working hours will be charged to the City at the rate of $20 per hour for secretarial assistance and $30 per hour for word processing assistance. When the request for such work is made by the City, we will notify you that the deadlines imposed will require that these extra charges be made. The Firm bills each file for time charges and expenses by line item on a monthly basis and fees are payable not later than thirty (30) days after receipt of our statement. The above- quoted rates are subject to review annually and are currently our rates to our municipal clients. Firm time records are processed by our in-house computer.
