<br />2. <br /> <br />Demised Premises. <br /> <br />It is understood between the parties to this lease that the <br /> <br />construction of a new terminal building at the airport may be <br /> <br />completed by the City of San Marcos during the term of this <br /> <br />lease. <br /> <br />Therefore, <br /> <br />City <br /> <br />the <br /> <br />of <br /> <br />San <br /> <br />Marcos, <br /> <br />hereinafter <br /> <br />referred <br /> <br />to <br /> <br />"Lessor", <br /> <br />hereby <br /> <br />as <br /> <br />leases <br /> <br />to <br /> <br />Eagle <br /> <br />Aero <br /> <br />Corporation, <br /> <br />Jeffery <br /> <br />Fox, <br /> <br />Bob <br /> <br />Powell <br /> <br />and <br /> <br />Susan <br /> <br />Powell, <br /> <br />hereinafter referred to as "Lessee" the following premises <br /> <br />located at the San Marcos Municipal Airport. <br /> <br />A. <br /> <br />Prior To Completion of New Terminal Buildinq. <br />Until such time as the City of San Marcos determines <br /> <br />that <br /> <br />construction <br /> <br />of <br /> <br />the <br /> <br />terminal <br /> <br />building <br /> <br />is <br /> <br />new <br /> <br />complete, Lessor shall lease, subject to the terms and <br /> <br />conditions herein this lease agreement, <br /> <br />to Lessee the <br /> <br />Hangar <br /> <br />C-Storage <br /> <br />Building <br /> <br />and <br /> <br />the <br /> <br />building <br /> <br />commonly <br /> <br />referred to as the civil Air Patrol Building at the <br /> <br />airport. <br /> <br />B. <br /> <br />After Completion of the New Terminal Buildinq. <br /> <br />Upon the determination by the City of San Marcos that <br /> <br />construction of the new terminal building is complete, <br /> <br />Lessee shall quit and surrender possession of the Hanger <br /> <br />C-Storage Building and Lessor shall lease to Lessee in <br /> <br />its place, <br /> <br />subject to the terms and condition of this <br /> <br />lease agreement, the office located at the south end of <br />what is commonly referred to as the Confederate Air <br /> <br />Force Building at the Airport, and Lessor will continue <br /> <br />to lease to Lessee the building commonly referred to as <br /> <br />the civil Air Patrol Building. <br /> <br />3. <br /> <br />Consideration. <br /> <br />A. <br /> <br />Prior to the Completion of New Terminal Buildinq. <br /> <br />(1) <br /> <br />As consideration and rental <br /> <br />for the demised premises <br /> <br />decribed in Section 2(A), above, Lessee agrees to pay to <br /> <br />Lessor the sum of Two Hundred Dollars <br /> <br />($200.00) <br /> <br />per <br /> <br />month, payment to be made in advance on the first day of <br />each month of this lease. <br /> <br />-2- <br />
