ORDINANCE NO. 2013 -51 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING THE TABLES IN SECTION 2.2 OF THE <br />DEVELOPMENT STANDARDS AND IN THE CONCEPT PLAN FOR <br />THE BLANCO RIVER VILLAGE SUBDIVISION PLANNED <br />DEVELOPMENT DISTRICT BY REMOVING THE AVERAGE PEOPLE <br />PER UNIT LIMITS; PROVIDING A SAVINGS CLAUSE; PROVIDING <br />FOR THE REPEAL OF ANY CONFLICTING PROVISIONS; AND <br />PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The Blanco River Village Subdivision Planned Development District consisting <br />of 103.788 acres of land, more or less, located in the 1400 through 1900 blocks of State Highway <br />21, was originally approved by Ordinances numbered 2004 -61 and 2008 -49, and amended by <br />Ordinances numbered 2012 -02 and 2012 -47. <br />2. City staff initiated a request to eliminate the average people per unit limits in <br />Section 2.2 of the Development Standards and in the Concept plan for the District and the <br />Planning and Zoning Commission has recommended approval of said request. <br />3. All requirements of the City's Land Development Code for amendments to the <br />Planned Development District Standards and Concept Plan have been met. <br />4. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION I. The tables in Section 2.2 of the Development Standards and in the <br />Concept Plan for the District are hereby amended to remove the average people per unit limits as <br />shown in Exhibit "A," attached hereto and made a part hereof (str-ikethrowgils indicate deleted <br />text). <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will <br />continue in force if they can be given effect without the invalid portion. <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 4. This ordinance will take effect after its passage, approval and adoption on <br />second reading. <br />
