69 RESOLUTION 1988-51R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AMENDMENT NO.2 TO THAT AGREEMENT BETWEEN SAID CITY AND THE UNITED STATES DEPARTMENT OF AGRICULTURE SOIL CONSERVATION SERVICE TO INCREASE THE COMPENSATION FOR ENGINEERING SERVICES IN CONNECTION WITH THE CONSTRUCTION OF A BASIC RECREATIONAL FACI LITYALONG THE SAN MARCOS RIVER, AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT, AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos entered into an agreement on November 4, 1985, with the United States Department of Agriculture Soil Conservation Service pertaining to the construction of a basic recreational facility along the San Marcos River; and, WHEREAS, said agreement contains provisions engineering services for said project; and, for contracted WHEREAS, on January 26, 1987, said agreement increase the compensation for such engineering was amended to serv ices; and, WHEREAS, the design requirements set forth in Phase II of said agreement have been increased, resulting in the necessity to again increase the compensation for engineering services; now, therefore, BE IT RESOLVED BY THE CITY TEXAS: COUNCI L OF THE CITY OF SAN MARCOS, PART 1. That the terms and conditions of Amendment No.2 To Project Agreement, a copy of which is attached hereto and incorporated herein for all purposes, are hereby approved. PART 2. That the Mayor is hereby authorized to execute said Amendment on behalf of the City of San Marcos. PART 3.
