73 STATE OF TEXAS AGREEMENT COUNTY OF HAYS KNOW ALL PERSONS BY THESE PRESENTS: This Agreement is made and entered into April 25, 1988 by and among the City of San Marcos, Texas (IICity") and Handler Smith and Colleen Smith Shelton, San Marcos, Texas ("Owner"). WITNESSETH: WHEREAS, City desires to construct a water production facility on Owner's 429 acres, more or less described in Exhibit A, attached hereto and incorporated herein by reference for all purposes, for the purpose of increasing well capacity for low level and high level systems within said City; and, WHEREAS, City desires to construct test holes on Owner's 429 acres of land described in Exhibit A for the purpose of locating the exact location of said water production facility; and, WHEREAS, City desires to purchase from Owner land upon which to construct said water production facility; and, vvHEREAS, City desires to construct a water transmission line through Owner's 429 acres of land described in Exhib it A, which will connec t City's existing water well at the McCarty Oaks Subdivision to City's water system along Hunter Road; and, WHEREAS, Owner desires to obtain service from said water transmission line for the purpose of supplying water to the 429 acres of land described on Exhibit A; and, WHEREAS, City desires that said water transmission line be of a greater size than is necessary to adequately serve the 429 acres of land; NOW, THEREFORE, for and in consideration of the mutual promises hereinafter expressed and other good and valuable consideration, the receipt of and sufficiency of which is hereby acknowledged and con fessed , the parties do hereby covenant and ag ree as follows:
