<br />
<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING 1.246 ACRES OF LAND SITUATED IN THE J.M. VERAMENDI
<br />LEAGUE NO.2 AND BEING THE SAME LAND CALLED FIRST TRACT
<br />AND SECOND TRACT IN A CONVEYANCE FROM T.B. LEE TO SHAW P.
<br />BREEDING RECORDED IN VOLUME 137, PAGES 187-188, OF THE
<br />HAYS COUNTY DEED RECORDS LOCATED AT 1901 RIVER ROAD FROM
<br />"PD" (PRE-DEVELOPMENT DISTRICT) TO "R-1" (SINGLE-FAMI LY
<br />DWELLING DISTRICT); AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on February 2, 1988 the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to change the
<br />zoning from "PO" (Pre-Development District) to "R-1"
<br />(Single-Family Dwelling District) of 1.246 acres of land situated in
<br />the J.M. Veramendi League No.2 and being the same land called First
<br />Tract and Second Tract, to the City of San Marcos, Hays County, Texas;
<br />and,
<br />
<br />WHEREAS,
<br />Commission
<br />voted to
<br />request be
<br />and,
<br />
<br />subsequent to said public hearing on said date, said
<br />did, on February 2, 1988, consider said request and
<br />approve the same and has recommended that such
<br />approved by the City Council of said City;
<br />

<br />WH~REAS, said City Council held a public hearing on the
<br />May, 1988, regarding such request: and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />TEXAS:

<br />SECTION 1. That the following tract of real property, located in
<br />San Marcos, Hays County, Texas, which was classified "PO" (Pre-
<br />Development District) upon its annexation to the City of San Marcos on
<br />November 24, 1980, henceforth shall be zoned "R-l" (Single-Family
<br />Dwelling District).

<br />FIELD NOTES describing 1.246 acres of land situated in the J.M.
<br />Veramendi League No.2 and being the same land called First
<br />Tract and Second Tract in a conveyance from T.B. Lee to Shaw P.
<br />Breeding recorded in Volume 137, pages 187-188, deed records,
<br />City of San Marcos, Hays County, Texas, and described by metes
<br />and bounds as follows:
<br />
<br />BEGINNING at an iron pipe found marking the southeast corner of
<br />this tract situated at the flare corner intersection of the
<br />northwest right-of-way of River Road with the northeast
<br />right-of-way of the Missouri, Kansas and Texas Railroad:
<br />
<br />THENCE with the flare, S 89 degrees 03' 48" W 66.38 feet to an
<br />iron pipe found situated in the northeast right-of-way of the
<br />Missouri, Kansas and Texas Railroad;
<br />
<br />THENCE with the northeast right-of-way of the Missouri, Kansas
<br />and Texas Railroad, N 75 degrees 09' 01" W 123.78 feet to an
<br />iron pipe found marking the southwest corner of this tract, the
<br />southwest corner of the called First Tract;
<br />
<br />THENCE N 18 degrees 25' 06" E 296.67 feet to an iron pipe found
<br />marking the northwest corner of the called Second Tract:
<br />
<br />THENCE S 74 degrees 21' 34" E 185.18 feet to an iron pipe found
<br />marking the northeast corner of the called Second Tract situated
<br />in the northwest right-of-way of River Road;
<br />
<br />THENCE with the northwest right-of-way of River road, S 18
<br />degrees 10' 00" W 275.94 feet to the PLACE OF BEGINNING and
<br />containing 1.246 acres of land.
