<br />I <br /> <br />RESOLUTION 2007- 142 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING THE PURCHASE OF A <br />PARCEL OF A WATER-WASETEWATER LINE EASEMENT <br />TOTALING 1.26 ACRES, MORE OR LESS, IN CONNECTION <br />WITH THE MCCARTY WATERLINE PROJECT; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE ALL NECESSARY <br />DOCUMENTS IN CONNECTION WITH THE PURCHASE; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City has negotiated the acquisition of a 1.26 acre water and wastewater line <br />easement as part of the construction of the 16 inch McCarty Waterline, phase II, project. <br /> <br />2. The City has agreed to pay $28,932 for the easement, along with the installation of <br />two stub-outs, and two service connections. <br /> <br />3. This project is an impact fee CIP project providing additional water capacity to the <br />McCarty line pressure plane. <br /> <br />I <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The following purchase of a water and wastewater line easement in <br />connection with the 16 inch McCarty Waterline, phase II, project is hereby approved: <br /> <br />A. the easement being 1.26 acres, more or less, of land out of the Nathaniel <br />Hubbard Survey, Abstract 230, as more particularly described in the <br />attached "Abel Easement Description" <br /> <br />the easement being purchased for the total price of $ 28,932, plus the value of certain <br />appurtenances. <br /> <br />Part 2. The City Manager, Dan O'Leary, is authorized to execute all necessary <br />documents in connection with the purchase of the easement as described above on <br />behalf of the City. <br /> <br />Part 3.
