99 ORDINANCE 1988-39 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 21, PUBLIC SAFETY, OF THE SAN MARCOS CODE OF ORDINANCES BY THE ADDITION OF SECTION 21-36 1/2, ARREST WITH WARRANT AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: ÞART 1. That Chapter 21, Public Safety, of the San Marcos Code of Ordinances is amended by the addition of Section 21-16 1/2 as follows: Sec. 21-36 1/2. Arrest With Warrant. Members of the Police Department shall have the authority to make arrests pursuant to the issuance and service of warrants. In compliance with the Texas Code of Criminal Procedure, Section 45.06, the Municipal Court shall collect a special expense in the amount of $25.00 for each warrant issued and served under TEX. PENAL CODE, 38.11 and under Article 6701d, 149 V.T.C.S. Such monies collected shall be placed in the general fund in a special account to be used to pay for expenses related to the service of such warrants. PART 2. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
