<br />100 <br /> <br />RESOLUTION 1988-58R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING A MUNICIPAL MAINTENANCE <br />AGREEMENT BETWEEN SAID CITY AND THE STATE OF TEXAS <br />FOR THE CONTINUED EXISTENCE, USE, OPERATION, AND <br />MAINTENANCE OF CERTAIN HIGHWAY TRAFFIC SIGNALS IN <br />SAID CITY; AUTHORIZING THE MAYOR FOR SAID CITY TO <br />EXECUTE SAID MUNICIPAL MAINTENANCE AGREEMENT AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, there are certain highway traffic signals in place <br />in the City of San Marcos; and, <br /> <br />WHEREAS, the State under the provisions of the Texas <br />Administrative Code Title 43 25.5, as amended has authority to <br />install, operate and maintain traffic signals on freeway-type <br />highways in all cities and on other highway routes in cities with <br />a population of less than 50,000 according to the latest Federal <br />Census; and, <br /> <br />WHEREAS, the City has a population of <br />according to the latest Federal Census; and, <br /> <br />less <br /> <br />than <br /> <br />50,000 <br /> <br />WHEREAS, the City has requested that the State assume the <br />maintenance and operation of certain highway traffic signals now <br />in place and has authorized the continued existence, use, <br />operation, and maintenance of said highway traffic signals; now, <br />therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS <br />TEXAS: <br /> <br />PART 1. That the Municipal Maintenance Agreement between <br />the City of San Marcos and the State of Texas for the continued <br />existence, use, operation, and maintenance of certain highway <br />traffic signals in said City at the locations shown on EXHIBIT 1 <br />of the agreement, a copy of which agreement being attached to this <br />resolution and made a part of it for all purposes is hereby <br />approved pursuant to the terms and conditions expressed therein. <br /> <br />PART 2. That Mayor of the City of San Marcos, Texas,Kathy <br />M. Mørri.s,be, andshe is hereby authorized to execute said Agreement <br />on behalf of said City and to transmit the same to the State of <br />Texas for appropriate action. <br /> <br />PART 3.
