c: -..Q N 106 ORDINANCE 1988-41 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE FOLLOWING SECTIONS OF CHAPTER 30, ARTICLE II, DIVISION 4, SEWAGE SYSTEM CAPITAL RECOVERY FEE: SECTION 30-41 TO REDEFINE "LUE"; SECTION 30-44 TO REDEFINE" LUE"; SECTION 30-45 TO BREAK DOWN THE LUE COMPUTATION FOR RESIDENTIAL USES INTO TWO (2) CATEGORIES, TO AMEND THE LUE COMPUTATION FOR RESTAURANT/BAR, FOR HOTEL/MOTELS WITH RESTAURANT AND/OR BAR, FOR LAUNDROMATS, AND FOR CAR WASHES, TO DELETE THE REFERENCES UNDER "HOTEL/MOTELS WITH RESTAURANT AND/OR BAR" AND "RESTAURANT/BAR" WITH RESPECT TO THE ASSESSMENT OF AN ADDITIONAL ANNUAL FEE, TO DELETE THE REFERENCE UNDER "INDUSTRIAL" TO ANNUAL INCREASE ADJUSTMENTS IN THE CRFN, TO ADD PROVISIONS FOR REASSESSMENT OF ANNUAL USAGE FEES FOR ALL NON-RESIDENTIAL USES FOR A FIVE (5) YEAR PERIOD, TO AMEND TERMS IN THE FORMULA USED FOR CALCULATION OF THE ANNUAL USAGE FEES; SECTION 30-48 TO REDEFINE LUEEC; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 30-41 of Division 4 of Article II of Chapter 30 of the Code of Ordinances of the City of San Marcos, Texas, is hereby amended to change the definition of "Living unit equivalent (LUE)" to read as follows: Living unit equivalent (LUE). A unit of development which produces the same flow as is produced by a single-family dwelling unit with three (3.0) occupants at one hundred (100) gallons per capita per day average flow or three hundred (300) gallons per day per unit. SECTION 2. That of said Chapter of follows: Section 30-44 of said Division of said Article said Code is hereby amended to read as Sec. 30-44. Amount of charge for new construction. Living Unit Equivalent (LUE)=unit of development which produces the same flow of three hundred (300) gallons of sewage per day as derived in Section 30-45. of SECTION 3. That Section 30-45 of said Division of said Article said Chapter of said Code is hereby amended to read as follows: Sec. 30-45. Computation of living various permitted uses. unit equivalents for . . .
