<br />ARTICLE 12 <br /> <br />OTHER DUTIES AS SET FORTH IN CONSTRUCTION CONTRACT DOCUMENTS <br /> <br />12.1 <br /> <br />Engineer shall have such other duties and responsibilities <br /> <br />and limitations of authority as agreed to by Engineer in writing and as <br /> <br />are set forth in the construction contract documents which are made a <br /> <br />part hereof and incorporated herein by reference as if copied herein <br /> <br />verbatim. <br /> <br />However, in the event of conflict, dispute, or discrepancy <br /> <br />between the provisions of this Agreement and the construction contract <br /> <br />documents, <br /> <br />the more <br /> <br />restrictive <br /> <br />and/or burdensome provisions <br /> <br />shall <br /> <br />govern and control. <br /> <br />ARTICLE 13 <br /> <br />BASIS OF COMPENSATION <br /> <br />The Owner shall compensate the Engineer for the Scope of Services <br /> <br />provided, in accordance with Article 5, Payments to the Engineer, <br /> <br />and the other terms and conditions of this Agreement, as follows: <br /> <br />13.1 <br /> <br />BASIC COMPENSATION <br /> <br />13.1.1 <br /> <br />For Basic Services, as described in Paragraphs 1.1 through <br /> <br />1.5, and any other services included in Article 14 as part of Basic <br /> <br />Services, Basic Compensation shall be computed as follows: <br /> <br />The total fee paid to Engineer shall not exceed the sum of FORTY <br />FIVE THOUSAND FOUR HUNDRED DOLLARS AND NO CENTS ($45,400.00). <br /> <br />Schematic Design Phase <br /> <br />30% <br /> <br />Design Development Phase <br />and Construction/Contract <br />Document Phase. <br /> <br />50% <br /> <br />Bidding Phase <br /> <br />10% <br /> <br />Construction-Administration <br />of Construction Contract 10% <br />13.2 COMPENSATION FOR ADDITIONAL SERVICES <br /> <br />13.2.1 <br /> <br />For Additional <br /> <br />Services <br /> <br />of the Engineer, <br /> <br />as described in <br /> <br />Paragraph 1.6, and any other services included in Article 14 as part of <br /> <br />Additional Services, Compensation shall be computed as follows: <br /> <br />On an hourly basis at the following rates: <br /> <br />Registered Professional $75.00 per hour <br />Engineer <br />Registered Public Surveyor $75.00 per hour <br />Graduate Engineer $60.00 per hour <br />Engineering Technician $60.00 per hour <br />Surveying Technician $60.00 per hour <br />Researcher $45.00 per hour <br />Draftsman $45.00 per hour <br /> <br />Secretary <br /> <br />$25.00 per hour <br /> <br />4 Man Survey $95.00 per hour <br />Field Crew <br />3 Man Survey $80.00 per hour <br />Field Crew <br />2 Man Survey $65.00 per hour <br />Field Crew <br />Expenses at Cost + 10% <br />
