-15- Sec. 37-26. Injunction. A person. who operates or causes to be operated a sexually oriented business with.out a valid license or in violation of Section 37-13 of this chapter is subject to a suit for injunction and/or for administrative penalties in addition to prosecution for criminal violations. Part 2. That section 30 of the General Zoning Ordinance is amended by the addition of Section (C) (3) as follows: Section 30. C. Commercial District. (C) Prohibited uses: (3) Any use of the property as a sexually oriented business unless a license to operate a business as a sexually oriented business has been granted by the Chief of Police after a public hearing has been conducted by the Zoning Commission before which time the Zoning Commission received a written report from the Chief of Police concerning his investigation of the application for a sexually oriented business, and at which time the Zoning commission has received an oral report on the investigation from the Chief of Police and after which the Zoning Commission has made a recommendation co~cerning the issuance of the license to the Chief of Police. Part 3. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
