<br />-8- <br /> <br />Sec. 37-8. <br /> <br />Expiration of license. <br /> <br />(a) Each license shall expire one year from the date of <br />issuance and may be renewed only by making application as <br />provided in Section 37-4. Application for renewal should be <br />made at least 60 days before the expiration date, however, <br />when made less than 60 days before the expiration date, the <br />expiration of the license will not be affected. <br /> <br />(b) When the Chief of Police denies renewal of a <br />license, the applicant should not be issued a license unless <br />the Chief of Police finds that the basis for denial of the <br />license renewal has been corrected or abated and a new public <br />hearing is then held as provided herein. <br /> <br />Sec. 37-9. <br /> <br />Suspension. <br /> <br />The Chief of Police shall suspend a license for a period <br />not to exceed 30 days if he determines that a licensee or an <br />employee of a licensee has: <br /> <br />(a) violated or is not in compliance with Section <br />37-7, 37-12, 37-13, 37-14, 37-15, 37-16, 37-17, 37-18, <br />37-19, or 37-20. <br /> <br />(b) been intoxicated while on the premises of the <br />sexually oriented business; <br /> <br />(c) refused to allow an inspection of the sexually <br />oriented business premises as authorized by this chapter; <br /> <br />(d) knowingly permitted gambling by any person on <br />the premises of the sexually oriented business; <br /> <br />(e) demonstrated inability to operate or manage a <br />sexually oriented business in a peaceful and law-abiding <br />manner resulting in law enforcement actions at, on or around <br />the premises. <br /> <br />Sec. 37-10. <br /> <br />Revocation. <br /> <br />(a) The Chief of Police shall revoke a license if a <br />cause of suspension in Section 37-9 occurs and the license <br />has been suspended within the preceding 12 months. <br /> <br />(b) The Chief of Police shall revoke a license if he <br />determines that: <br /> <br />(1) a licensee gave false or misleading <br />information in the material submitted to the Chief of Police <br />during the application process; <br /> <br />(2) a licensee or an employee has knowingly <br />allowed possession, use, or sale of controlled substances on <br />the premises; <br /> <br />(3) a licensee or an employee <br />allowed prostitution on the premises; <br /> <br />has <br /> <br />knowingly <br /> <br />(4) a licensee or an employee knowingly operated <br />the sexually oriented business during a period of time when <br />the licensee's license was suspended; <br /> <br />(5) a licensee has been convicted of an offense <br />listed in Section 37-5 (a) (10) (A) for which the time period <br />required in Section 37-5(a) (10) (B) has not elapsed; <br /> <br />(6) on two or more occasions within a 12-month <br />period, a person or persons committed a criminal offense in <br />or on the licensed premises and such criminal offense is <br />
