60 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, JUNE 12, 1984 PRESENT: Mayor Enunie Craddock Council Members Karl W. Brown Bill Coddington Gerald G. Farr Fred Guerra Betty Jane Kissler * Jaime Moore City Manager A. C. Gonzalez City Secretary Janis K. Womack City Attorney Lamar W. Hankins Also Present: Bill Thomas, Tom McNair and others. Mayor Craddock called the meeting to order at 5:30 p.m. Mr. Farr moved the Council move the Executive Session to this por- tion of the Agenda and that the Council adjourn into Executive Ses- sion pursuant to Article 6252-17, §2 (e) and §2(g), V.A.C.S., to dis- cuss personnel, contemplated litigation and pending litigation (Kyle vs. City) and matters where the duty of a public body's counsel to his client pursuant to the Code of Professional Responsibility clearly conflicts with this Article. Mr. Guerra seconded the motion, which passed unanimously (5:31 p.m.). Mr. Coddington moved the Council convene at 6:40 p.m. and Mr. Brown seconded the motion, which passed unanimously. Mayor Craddock introduced for consideration approval of the Zoning Ordinance on second reading, the caption which was read as follows: APPENDIX A - GENERAL ZONING ORDINANCE AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND; DECLARING THE PURPOSE; PROVIDING FOR CHANGES AND AMENDMENTS; ESTABLISHING AN OFFICIAL ZONING MAP; ESTABLISHING DE- FINITIONS; DESIGNATING DISTRICTS; PROHIBITING USE; PRO- VIDING FOR NEWLY ESTABLISHED TERRITORY; SETTING FORTH USE RESTRICTIONS IN THE SEVERAL DISTRICTS; ESTABLISHING LAND COVERAGE; PROVIDING FOR PARKING; PROVIDING FOR SETBACK; DEFINING NONCONFORMING USES; PROVIDING FOR A BOARD OF ADJUSTMENT; PROVIDING ENFORCEMENTS AND REMEDIES; CLARIFYING CONFLICTING ORDINANCES; PROVID- ING FOR A SAVINGS CLAUSE; AND ESTABLISHING AN EFFECT- IVE DATE. Mayor Craddock moved for approval of the Ordinance on second reading and Ms. Kissler seconded the motion. There was a discussion regard- ing the maximum building coverage as a percentage of lot area being changed from 60% to possibly 75% in TH1, 2 and 3 Districts. Bill Thomas is to make a recommendation at third reading to the Council (June 13, 1984). Tom McNair stated he thought the new Ordinance would be more restrictive, and gave as an example duplexes where in his opinion the depth of the lots would be more restrictive. Mr. Farr stated there would always be the option of a variance if needed. The Council voted unanimously for approval of the Ordinance on second reading. * Jaime Moore was not present at this meeting.
