<br /> 60 <br /> MINUTES OF THE SPECIAL MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, JUNE 12, 1984 <br />PRESENT: Mayor Enunie Craddock <br /> Council Members Karl W. Brown <br /> Bill Coddington <br /> Gerald G. Farr <br /> Fred Guerra <br /> Betty Jane Kissler <br /> * Jaime Moore <br /> City Manager A. C. Gonzalez <br /> City Secretary Janis K. Womack <br /> City Attorney Lamar W. Hankins <br />Also Present: Bill Thomas, Tom McNair and others. <br />Mayor Craddock called the meeting to order at 5:30 p.m. <br />Mr. Farr moved the Council move the Executive Session to this por- <br />tion of the Agenda and that the Council adjourn into Executive Ses- <br />sion pursuant to Article 6252-17, §2 (e) and §2(g), V.A.C.S., to dis- <br />cuss personnel, contemplated litigation and pending litigation (Kyle <br />vs. City) and matters where the duty of a public body's counsel to <br />his client pursuant to the Code of Professional Responsibility clearly <br />conflicts with this Article. Mr. Guerra seconded the motion, which <br />passed unanimously (5:31 p.m.). <br />Mr. Coddington moved the Council convene at 6:40 p.m. and Mr. Brown <br />seconded the motion, which passed unanimously. <br />Mayor Craddock introduced for consideration approval of the Zoning <br />Ordinance on second reading, the caption which was read as follows: <br /> APPENDIX A - GENERAL ZONING ORDINANCE <br /> AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION <br /> AND USE OF BUILDINGS, STRUCTURES AND LAND; DECLARING <br /> THE PURPOSE; PROVIDING FOR CHANGES AND AMENDMENTS; <br /> ESTABLISHING AN OFFICIAL ZONING MAP; ESTABLISHING DE- <br /> FINITIONS; DESIGNATING DISTRICTS; PROHIBITING USE; PRO- <br /> VIDING FOR NEWLY ESTABLISHED TERRITORY; SETTING FORTH <br /> USE RESTRICTIONS IN THE SEVERAL DISTRICTS; ESTABLISHING <br /> LAND COVERAGE; PROVIDING FOR PARKING; PROVIDING FOR <br /> SETBACK; DEFINING NONCONFORMING USES; PROVIDING FOR <br /> A BOARD OF ADJUSTMENT; PROVIDING ENFORCEMENTS AND <br /> REMEDIES; CLARIFYING CONFLICTING ORDINANCES; PROVID- <br /> ING FOR A SAVINGS CLAUSE; AND ESTABLISHING AN EFFECT- <br /> IVE DATE. <br />Mayor Craddock moved for approval of the Ordinance on second reading <br />and Ms. Kissler seconded the motion. There was a discussion regard- <br />ing the maximum building coverage as a percentage of lot area being <br />changed from 60% to possibly 75% in TH1, 2 and 3 Districts. Bill <br />Thomas is to make a recommendation at third reading to the Council <br />(June 13, 1984). Tom McNair stated he thought the new Ordinance <br />would be more restrictive, and gave as an example duplexes where in <br />his opinion the depth of the lots would be more restrictive. Mr. <br />Farr stated there would always be the option of a variance if needed. <br />The Council voted unanimously for approval of the Ordinance on second <br />reading. <br />* Jaime Moore was not present at this meeting. <br />
