<br />134 <br /> <br />RESOLUTION 1988-63R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, SUPPORTING THE ESTABLISHMENT OF AN <br />ENHANCED 9-1-1 EMERGENCY TELEPHONE NUMBER AND THE <br />IMPLEMENTATION OF THE 9-1-1 FEE AND SURCHARGE, IN SAN <br />MARCOS, TEXAS AND CHOOSING TO PARTICIPATE IN THE 9-1-1 <br />REGIONAL PLAN IN ACCORDANCE WITH ARTICLE l432f OF <br />VERNON'S TEXAS CIVIL STATUTES; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the 9-1-1 Emergency Telephone Number is a dedicated <br />nationwide emergency number for police, fire and ambulance <br />services which provides major lifesaving advantages to citizens and <br />public safety agencies; and, <br /> <br />WHEREAS, Article l432f of Vernon's Texas Civil Statutes, as <br />amended, authorizes the establishment of the Advisory Commission on <br />State Emergency Communcations and the implementation of a Enhanced <br />9-1-1 Emergency Telephone System in Texas; and, <br /> <br />WHEREAS, Article l432f <br />through the development of <br />having a population of 120,000 <br />to participate in the plan by <br />and, <br /> <br />authorizes the implementation of 9-1-1 <br />regional plans and allows for counties <br />or less and cities within those counties <br />resolution of their governing bodies; <br /> <br />WHEREAS, Article l432f <br />State Emergency Communcations <br />the plan, a 9-1-1 service <br />local exchange access line <br />receiving intrastate long <br />percent; and, <br /> <br />authorizes the Advisory Commission on <br />to establish in areas participating in <br />fee of not more than 50 cents a month per <br />and a 9-1-1 surcharge on each customer <br />distance service of not more than one-half <br /> <br />WHEREAS, 9-1-1 service fees and surcharges will not be collected <br />until the CAPCO plan is approved by the CAPCO Executive Committee, <br />participating governments, and the Advisory Commission on State <br />Emergency Communications; and, <br /> <br />WHEREAS, a local government participating in the CAPCO 9-1-1 plan <br />may, by resolution, elect to withdraw from the CAPCO plan prior to <br />approval by the Advisory Commission on State Emergency Communications; <br />now, there fore, <br /> <br />BE <br />TEXAS: <br /> <br />IT <br /> <br />RESOLVED <br /> <br />BY <br /> <br />THE <br /> <br />CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> <br />PART 1. That the City Council of the City of San Marcos supports <br />the establishment of an enhanced 9-1-1 Emergency Telephone Number and <br />the implementation of the 9-1-1 fee and surcharge in San Marcos, Texas, <br />and chooses to participate in the 9-1-1 regional plan in accordance <br />with Article l432f, of the Vernon's Texas Civil Statutes. <br /> <br />PART 2.
