135 RESOLUTION 1988-64R A RESOLU'rION OF THE CITY COUNCIL OF THE CITY OF SAN f'1ARCOS, TEXAS APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT FOR MUTUAL AID IN FIRE PROTECTION BETWEEN SAID CITY AND THE SOUTH HAYS COUNTY VOLUNTEER FIRE DEPARTMENT, INC., AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE SAID AGREEMENT, AND DECLARING AN EFFECTIVE DATE. \"1HEREAS, the State of Texas pursuant to Article 6228f, Texas Revised Civil Statutes, has declared it to be the public policy of the State to provide financial assistance to the surviving spouse and minor children of paid firefighters when such paid firefighters suffer violent death in the course of the performance of their duties; and, WHEREAS, the federal government, pursuant to 42 U.S.C.S. Section 3796, provides for the payment of certain benefits to the surviving spouse and/or children of public safety officers who have died as a "proximate result of a personal injury sustained in the line of duty"; and, WHEREAS, insurance contracts entered into by some firefighters and various pension systems provide for the payment of death, disability and/or injury benefits when death or injury occur "in the line of duty"; and, WHEREAS, it is to the benefit of the firefighters of the City of San Marcos to have clearly established that responding to or working at a fire or other emergency outside said City's jurisdictional area but within an area for which the Ci ty of San Marcos has entered into an Agreement for Mutual Aid In Fire Protection is work "in the line of duty" for City of San Marcos firefighters; and, vJHEREAS, the Ci ty of San r-1arcos has the author i ty, pursuant to its Charter and State law, to enter into agreernents for the provision of fire protection services; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the terms and conditions of an Agreement for Mutual Aid In Fire Protection between the Ci ty of San Marcos, Texas and the South Hays County Volunteer Fire Department, Inc., a copy of which is attached hereto and incorporated herein for all intents and purposes, are hereby approved in all respects. PART 2. That the Mayor of the Ci ty of San Marcos, Texas, is hereby authorized to execute said Agreement on behalf of the City of San Marcos, Texas. PART 3.
