<br />135 <br /> <br />RESOLUTION 1988-64R <br /> <br />A RESOLU'rION OF THE CITY COUNCIL OF THE <br />CITY OF SAN f'1ARCOS, TEXAS APPROVING THE <br />TERMS AND CONDITIONS OF AN AGREEMENT FOR <br />MUTUAL AID IN FIRE PROTECTION BETWEEN <br />SAID CITY AND THE SOUTH HAYS COUNTY <br />VOLUNTEER FIRE DEPARTMENT, INC., <br />AUTHORIZING THE MAYOR OF SAID CITY TO <br />EXECUTE SAID AGREEMENT, AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />\"1HEREAS, the State of Texas pursuant to Article 6228f, <br />Texas Revised Civil Statutes, has declared it to be the <br />public policy of the State to provide financial assistance to <br />the surviving spouse and minor children of paid firefighters <br />when such paid firefighters suffer violent death in the <br />course of the performance of their duties; and, <br /> <br />WHEREAS, the federal government, pursuant to 42 U.S.C.S. <br />Section 3796, provides for the payment of certain benefits to <br />the surviving spouse and/or children of public safety <br />officers who have died as a "proximate result of a personal <br />injury sustained in the line of duty"; and, <br /> <br />WHEREAS, insurance contracts entered into by some <br />firefighters and various pension systems provide for the <br />payment of death, disability and/or injury benefits when <br />death or injury occur "in the line of duty"; and, <br /> <br />WHEREAS, it is to the benefit of the firefighters of <br />the City of San Marcos to have clearly established that <br />responding to or working at a fire or other emergency outside <br />said City's jurisdictional area but within an area for which <br />the Ci ty of San Marcos has entered into an Agreement for <br />Mutual Aid In Fire Protection is work "in the line of duty" <br />for City of San Marcos firefighters; and, <br /> <br />vJHEREAS, the Ci ty of San r-1arcos has the author i ty, <br />pursuant to its Charter and State law, to enter into <br />agreernents for the provision of fire protection services; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. That the terms and conditions of an Agreement <br />for Mutual Aid In Fire Protection between the Ci ty of San <br />Marcos, Texas and the South Hays County Volunteer Fire <br />Department, Inc., a copy of which is attached hereto and <br />incorporated herein for all intents and purposes, are hereby <br />approved in all respects. <br /> <br />PART 2. That the Mayor of the Ci ty of San Marcos, <br />Texas, is hereby authorized to execute said Agreement on <br />behalf of the City of San Marcos, Texas. <br /> <br />PART 3.
