<br />duty, of the San Marcos Fire Department by the above- <br />designated personnel of the South Hays County Volunteer Fire <br /> <br />Department, Inc., firefighting equipment, if available and in <br />good working order, and personnel, if available, of the San <br /> <br />Marcos <br /> <br />Fire <br /> <br />Department <br /> <br />shall <br /> <br />be dispatched to <br /> <br />any point <br /> <br />within the geographical area of South Hays County Rural Fire <br /> <br />Prevention District. <br /> <br />III. <br /> <br />South <br /> <br />Hays <br /> <br />County <br /> <br />Volunteer <br /> <br />Fire <br /> <br />Department, <br /> <br />Inc. , <br /> <br />agrees to hold harmless the San Marcos Fire Department for <br /> <br />any loss, damage, personal injury, or death occurring as a <br /> <br />result of the negligence of the San Marcos Fire Department in <br /> <br />carrying <br /> <br />out <br /> <br />a <br /> <br />performance <br /> <br />under <br /> <br />Article <br /> <br />II <br /> <br />of <br /> <br />this <br /> <br />Agreement, regardless of whether such loss, damage, personal <br /> <br />injury, <br /> <br />or death <br /> <br />is <br /> <br />caused <br /> <br />in whole <br /> <br />or <br /> <br />in part by the <br /> <br />negligence of the San Marcos Fire Department. <br /> <br />IV. <br /> <br />In the event of a serious fire or fires, as determined <br /> <br />by the Director of Police and Fire, or the Fire Chief, or, in <br /> <br />their absence, the Shift Captain, on duty, of the San Marcos <br /> <br />Fire Department, located within the geographical firefighting <br />jurisdiction of the San Marcos Fire Department (as designated <br /> <br />by said personnel of the San Marcos Fire Department) or, in <br />the event equipment of said fire department is insufficient, <br /> <br />incapable or unavailable for any reason to fight a fire or <br />fires, as determined by said personnel of the San Marcos Fire <br /> <br />Department, located within said geographical jurisdiction of <br /> <br />the San Marcos Fire Department; or in both such events, then, <br /> <br />upon <br /> <br />request <br /> <br />to <br /> <br />the Volunteer <br /> <br />Fire <br /> <br />Chief, <br /> <br />the Volunteer <br /> <br />Assistant Fire Chief, or, in the absence of both of them, the <br /> <br />Volunteer Fire Officer on duty, of the South Hays <br /> <br />County <br /> <br />Volunteer <br /> <br />Fire <br /> <br />Department, <br /> <br />Inc., <br /> <br />by <br /> <br />the <br /> <br />above-designated personnel of the San Marcos Fire Department, <br /> <br />firefighting equipment, <br /> <br />if <br /> <br />available <br /> <br />and <br /> <br />in good working <br /> <br />order, and personnel if available, of the South Hays County <br /> <br />Volunteer Fire Department, Inc., shall be dispatched to any <br />
