A. VII. Each party hereto agrees to maintain its equipment to be used in such mutual aid in fire protection in good working order and to ensure that its personnel are competently trained in the use of such equipment and in firefighting in general, at a level of competency no less than the standard of professional firefighting competency common to firefighting departments in the state of Texas. B. South Hays County Volunteer Fire Department, Inc., agrees to hold harmless the San Marcos Fire Department for any loss, damage, personal injury, or death occurring as a 'consequence of the failure or negligence of the San Marcos Fire Department to fully comply with paragraph A of this Article VII, regardless of whether such loss, damage, personal injury, or death is caused in whole or in part by the negligence of the San Marcos Fire Department. C. San Marcos Fire Department agrees to hold harmless the South Hays County Volunteer Fire Department, Inc., for any loss, damage, personal injury, or death occurring as a consequence of the failure or negligence of the South Hays County Volunteer Fire Department, Inc. to fully comply with paragraph A of this Article VII, regardless of whether such loss, damage, personal injury, or death is caused in whole or in part by the negligence of the South Hays County Volunteer Fire Department, Inc. VIII. No party shall be reimbursed by any other party for any expenses and costs incurred pursuant to this Agreement, except as specified under Articles III, V, and VII. IX. All equipment used by the San Marcos Fire Department in carrying out this Agreement will, at the time of action hereunder, be owned by it; and all personnel acting for the San Marcos Fire Department under this Agreement will, at the
