<br />A. <br /> <br /> VII. <br />Each party hereto agrees to maintain its equipment <br />to be used in such mutual aid in fire protection in <br />good working order and to ensure that its personnel <br />are competently trained in the use of such <br /> <br />equipment <br /> <br />and <br /> <br />in <br /> <br />firefighting <br /> <br />in general, <br /> <br />at a <br /> <br />level of competency no less than the standard of <br /> <br />professional <br /> <br />firefighting <br /> <br />competency <br /> <br />common <br /> <br />to <br /> <br />firefighting departments in the state of Texas. <br /> <br />B. <br /> <br />South Hays County Volunteer Fire Department, Inc., <br /> <br />agrees <br /> <br />to <br /> <br />hold <br /> <br />harmless <br /> <br />the <br /> <br />San <br /> <br />Marcos <br /> <br />Fire <br /> <br />Department for any loss, damage, personal injury, <br />or death occurring as a 'consequence of the failure <br /> <br />or negligence of the San Marcos Fire Department to <br /> <br />fully comply with paragraph A of this Article VII, <br /> <br />regardless of whether such loss, damage, personal <br />injury, or death is caused in whole or in part by <br /> <br />the negligence of the San Marcos Fire Department. <br /> <br />C. <br /> <br />San Marcos Fire Department agrees to hold harmless <br />the South Hays County Volunteer Fire Department, <br /> <br />Inc., <br /> <br />for any loss, <br /> <br />damage, <br /> <br />personal injury, <br /> <br />or <br /> <br />death occurring as a consequence of the failure or <br />negligence of the South Hays County Volunteer Fire <br /> <br />Department, Inc. to fully comply with paragraph A <br /> <br />of this Article VII, <br /> <br />regardless of whether such <br /> <br />loss, damage, personal injury, or death is caused <br /> <br />in whole or in part by the negligence of the South <br />Hays County Volunteer Fire Department, Inc. <br /> <br />VIII. <br /> <br />No party shall be reimbursed by any other party for any <br /> <br />expenses <br /> <br />and <br /> <br />costs <br /> <br />incurred <br /> <br />pursuant <br /> <br />to <br /> <br />this <br /> <br />Agreement, <br /> <br />except as specified under Articles III, V, and VII. <br /> <br />IX. <br /> <br />All equipment used by the San Marcos Fire Department in <br /> <br />carrying out this Agreement will, <br /> <br />at the time of action <br /> <br />hereunder, be owned by it; and all personnel acting for the <br /> <br />San Marcos Fire Department <br /> <br />under this Agreement will, at the <br />
