ORDINANCE NO. 2013 - 56 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS DESIGNATING A NO PARKING TOW -AWAY ZONE <br />AT ALL TIMES ON BOTH SIDES OF FOXTAIL RUN EAST OF <br />HUNTER ROAD AND AMENDING THE TRAFFIC REGISTER <br />MAINTAINED UNDER SECTION 82.067 OF THE SAN MARCOS CITY <br />CODE TO REFLECT SUCH DESIGNATION; AND INCLUDING <br />PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. The designation of a no parking tow -away zone at all times on both sides of <br />Foxtail Run east of Hunter Road is in the interest of the public health, safety and welfare. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. A no parking tow -away zone, to be in effect at all times, is hereby <br />designated on both sides of Foxtail Run east of Hunter Road. <br />SECTION 2. The Traffic Register maintained under section 82.067 of the San Marcos <br />City Code is amended to reflect the no parking tow -away designation established under Section <br />1. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 5. This ordinance shall become effective upon adoption on second reading. <br />PASSED AND APPROVED on first reading on September 17, 2013. <br />PASSED, APPROVED AND ADOPTED on second reading on October 2, 2013. <br />(::Da ' 1 Guerrero <br />ayor <br />
