<br />I (We) acknowledge receipt ot the following addendum (addenda): <br />Texas Health Plans, Inc. <br /> <br />Upon receipt of written notice of the award of this bid, <br />Texas Health Plans, Inc. <br /> <br />will immediately enter into an agreement to taka eftect May 1, 1988 <br />with the City at San Marcos in a fona (or torma) similar to that <br />attached aa a specimen to thi8 bid or in 80me fona mutually agreeable <br />to Texas Health Plans, Inc. <br /> <br />and the City of San Marcos. <br /> <br />Attached hereto is an affidavit in proof that the undersigned has not <br />entered into a collusive agreement with any person in respect to this <br />Bid or any other Bid or the submitting ot Bids for Contract for which <br />this Bid is submitted. <br /> <br />In submitting this bid, I hereby represent that I : (1) have examined, <br />read and understand the specifications and other information provided <br />in this bid packet: (2) am familiar with the nature and extent of the <br />specifications and other intormation provided in this bid packet and <br />all local conditions and laws and regulations that in any manner may <br />affect cost progress, performance or turnishinq of the services: and, <br />(3) have given the City of San Marcos written notice ot all conflicts, <br />omissions, errors and discrepancies discovered in the bid package and <br />the written response and/or resolution thereof by the City of San <br />Marcos is acceptable to me. <br /> <br />The undersigned certities that the bid prices contained in this Bid <br />have been carefully checked and are submitted as correct and final. <br />The undersigned acknowledges that the executed bid documents of the <br />successful Bidder shall form a part of the contract subsequently <br />entered into between the City of San Marcos and the successtul Bidder <br />as it the same were copied therein verbatim. The undersigned further <br />acknowledges that in the event of ~onflict between the provisions <br />contained in the contract and the provisions contained in the bid <br />documents, the provisions contained in the contract will prevail. <br /> <br />The undersigned acknowledges that time is of the essence and that the <br />City of San Marcos will be damaged if the services offered herein are <br />not commenced timely in accordance with the specifications. <br /> <br />I understand that unit and lump sum prices must be shown in words and <br />figures tor each item in this Bid, and in the event of discrepancy, the <br />words shall control. <br /> <br />B-5 <br />
