<br />179 <br /> <br />RESOLUTION 1988-78R <br /> <br />A IŒSOLUT IOr.J OF 'i'HE Crrl'Y COUNCIL OF THE CITY <br />OF Si\N r1l\RCOS, TEXAS CERTIFYING THNX' SAID CITY <br />IS ELIGIBLE TO RECEIVE ASSISTANCE THROUGH <br />GRANT PROGRM1S, DESIGNATING CERTAIN OFFICIALS <br />AS BEiNG RESPONSIBLE FOR, ACTING FOR, AIm ON <br />BEHALF UF SAID CITY IN DEALING WITH THE TEXAS <br />PARKS AND WILDLIFE DEPAR~MENT FOR THE PURPOSE <br />OF PARTICIPATING IN SAID PROGRAMS, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />\Vl!EREAS, the Uni ted States Congress has ¡:>assed the Lan\~ and <br />Water Conservation Fund Act of 1965, authorizing the Secretary of <br />the Interior to provide financial assistance to states and <br />pol i tical subd i v is ions thereof for outdoor recrea t ion purposes; <br />and, <br /> <br />WHEREAS, the Texas Legislature has approved the Parks & <br />\'JilcJ1ife Code, Section 13.3\;)9 for the purpose of allowing the <br />State of 'l'exas and its ¡Jolitical subdivisions to participate in <br />the FeJeral Assistance Program established ut1(ìer the Land and <br />Water Conservation Fund Act of 1965, or such other programs as are <br />hereinafter established by the federal government; and, <br /> <br />\~HEREAS , the Texas Leg is 1a ture has approved the Parks - ami <br />Ç.1ildlife Code, Section 24.CíJ5 for the purpose of allo\"!ing the <br />political subdivision of the State of Texas to participate in the <br />Texas Local Parks, Recreation, and Open Space Fund; and <br /> <br />WHEREAS, the City of San Marcos is fully eligible to receIve <br />assistance under these programs; now therefore, <br /> <br />BE I'r RESOLVED BY <br />TEXAS: <br /> <br />THE CITY COUNCIL OF THE CITY <br /> <br />OF <br /> <br />SAN ìlARCOS, <br /> <br />PAH'l' 1. Tha t the Ci ty Coline i 1 of the Ci ty ot San i'lareo s, <br />Texas hereby certifies that said City is eligible to receive <br />assistance under the Land and Water Conservation Fund Act of 1965 <br />and Section 24.3Ø5 of the Texas Parks and Wildlife Code. <br /> <br />PAR'I 2. Farley, is hereby autÌ1Orize.:] to serve as <br />said City's fiscal officer to receive grant funds for the purposes <br />of these programs. <br /> <br />PART 4. That the Ci ty r-1anager and Director of Finance are <br />hereby autho r i zed to make appl ica t i on to thE:! Texas Par ks clnd <br />Wildlife Department for financial assistance concerning the site <br />to be known as the City of San Marcos Parkland and wildlife <br />Habitat in the City of San narcos, Texas for use as a park site, <br />and that said site, upon completion of its acqui[.;ition, '\.-lÍ1I be <br />dedicated for public outdoor recreation purposes in perpetuity. <br /> <br />PART 5.
