<br /> <br /> <br /> <br />184 <br /> <br />ORDINANCE 1988-55 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, REPEALING ORDINANCE NO. 1988-7, WHICH <br />CREATED A MUNICIPAL COURT OF RECORD, UNTIL FURTHER <br />ACTION OF THE CITY COUNCIL AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City Council created a Municipal Court of Record for <br />the City of San Marcos effective January 21, 1988~ and, <br /> <br />WHEREAS, as required by State law, the City held a referendum to <br />determine the method of selection for the judge of the Municipal Court <br />of Record; and, <br /> <br />WHEREAS, the voters in said election voted in favor of <br />elected judge of the Municipal Court of Record; and, <br /> <br />having <br /> <br />an <br /> <br />WHEREAS, the City Council desires to carry out the City's business <br />in the most fiscally responsible manner possible; and, <br /> <br />WHEREAS, the cost of conducting a special election on the <br />second Saturday in August, 1988, the next date prescribed by law on <br />which to have an election, is estimated to be $10,000.00; and, <br /> <br />WHEREAS, the Municipal Court of Record cannot be properly operated <br />after that date without an elected judge; and, <br /> <br />WHEREAS, the City Council desires that the term of the Municipal <br />Court of Record Judge be concurrent with the terms of the City Council <br />Members so that the regular elections for said judge will be held in <br />conjunction with regular City Council elections in the future; and, <br /> <br />WHEREAS, the City Council desires that the Municipal Court of <br />Record judge be a full-time judge who does not engage in the private <br />practice of law~ and, <br /> <br />WHEREAS, the City Council believes that all of these matters can <br />be resolved at the next session of the Texas Legislature which <br />beg ins in January, 1989 ~ and, <br /> <br />WHEREAS, the City Council believes that it is in the best interest <br />of the City of San Marcos and its citizens that the Municipal Court of <br />Record be temporarily suspended through the repeal of the Municipal <br />Court of Record Ordinance until further action of the City Council~ <br />now, there fore, <br /> <br />BE IT ORDAINED BY THE CITY <br />TEXAS: <br /> <br />COUNCI L OF <br /> <br />THE <br /> <br />CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />PART 1. That the recitals found in the above preamble to this <br />ordinance are adopted in their entirety as part of this ordinance <br />for all intents and purposes. <br /> <br />PART 2. That Ordinance No. 1988-7, which created a Municipal <br />Court of Record for the City of San Marcos, be and it is hereby <br />repealed until further action of the City Council. <br /> <br />PART 3.
