(4) Bonds under which the obligations of the City have been released, discharged or <br />extinguished in accordance with the terms thereof. <br />"Permitted Investments" means any security or obligation or combination thereof permitted <br />under the Public Funds Investments Act, Chapter 2256, Texas Government Code, as amended or <br />other applicable law. <br />"Premium Compound Interest Bonds" means the Bonds on which no interest is paid prior to <br />maturity, maturing in various amounts and in the aggregate principal amount as set forth in the <br />Pricing Certificate. <br />"Pricing Certificate" means the Pricing Certificate ofthe City's Pricing Officer to be executed <br />and delivered pursuant to Section 4 hereof in connection with the issuance of the Bonds. <br />"Pricing Officer" means the Interim City Manager, acting as the designated pricing officer <br />of the City to execute the Pricing Certificate. In the absence of the Interim City Manager, the <br />Director of Finance may act as the designated pricing officer of the City to execute the Pricing <br />Certificate. <br />"RatingAgency" means any nationally recognized securities rating agency which has assigned, <br />at the request of the City, a rating to the Parity Obligations. <br />"Record Date" means Record Date as defined in Section 7 the Form of Bonds. <br />"Redemption Date" means a date fixed for redemption of any Bond pursuant to the terms of <br />this Ordinance. <br />"Refunded Obligations" means those Refundable Obligations designated by the Pricing Officer <br />in the Pricing Certificate to be refunded. <br />"Refundable Obligations" means all or a portion of the outstanding Series 2001 Certificates, <br />Series 2002 Certificates, Series 2003 Certificates and Series 2003 Bonds. <br />"Register" or "Registration Books" means the registry system maintained on behalf ofthe City <br />by the Registrar in which are listed the names and addresses of the Registered Owners and the <br />principal amount of Bonds registered in the name of each Registered Owner. <br />"Replacement Bonds" means the Bonds authorized by the City to be issued in substitution for <br />lost, apparently destroyed, or wrongfully taken Bonds as provided in Section 10 of this Ordinance. <br />"Rule" means SEC Rule 15c2 -12, as amended from time to time. <br />"SEC" means the United States Securities and Exchange Commission. <br />San Marcos GORB 2010 - Delegated: Ordinance A -4 <br />
