<br />INTRODUCTION <br /> <br />WHEREAS City of San Marcos, hereinafter referred to as the "Employer," hereby <br />establishes the benefits, rights, and privileges which shall pertain to <br />Participating Employees, hereinafter referred to as "Participants," and the <br />Eligible Dependents of such Participants, as herein defined, and which <br />benefits are provided through a Fund established by the Employer and <br />hereinafter referred to as the "Plan." <br /> <br />PURPOSE <br /> <br />The purpose of the Plan Document is to set forth the provisions of the Plan <br />which provide for the payment of reimbursement of all or a portion of eligible <br />medical expenses. <br /> <br />EFFECTIVE DATE <br /> <br />The effective date of the Plan is August 1, 1988. <br /> <br />PLAN SUPERVISOR AND CLAIMS ADMINISTRATOR <br /> <br />The Supervisor and Claims Administrator of the Plan is Boon-Chapman, Ltd. <br /> <br />NAMED FIDUCIARY AND PLAN ADMINISTRATOR <br /> <br />The Named Fiduciary and Plan Administrator is City of San Marcos who shall <br />have the authority to control and manage the operation and administration of <br />the Plan. The Employer shall have the authority to amend the Plan, to <br />determine its policies, to appoint and remove other supervisors, fix their <br />compensation (if any), and exercise general administrative authority over <br />them. The Administrator has the sole authority and responsibility to review <br />and make final decisions on all claims to benefit hereunder. <br /> <br />PLAN AMENDMENTS <br /> <br />This Document contains all the terms of the Plan and may be amended from time <br />to time by the Employer. Any changes so made shall be binding on each Covèred <br />Participant and on any other Covered Persons referred to in this Plan <br />Document. <br /> <br />TERMINATION OF PLAN <br /> <br />The Employer reserves the right at any time to terminate the Plan by a written <br />instrument to that effect. All previous contributions by the Employer shall <br />continue to be issued for the purpose of paying benefits under the provisions <br />of this Plan with respect to claims arising before such termination, or shall <br />be used for the purpose of providing similar health benefits to Cover <br />Participants, until all contributions are exhausted. <br /> <br />PLAN IS NOT A CONTRACT <br /> <br />This Plan Document constitutes the entire Plan. The Plan will not be deemed <br />to constitute a contract of employment or give any Participant the right to be <br />retained in the service of the Employer or to interfere with the right of the <br />Employer to discharge or otherwise terminate the employment of any <br />Participant. <br /> <br />1 <br />
