ORDINANCE NO. 2013-59 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 66, ARTICLE 2 — <br />RESIDENTIAL AND MULTIFAMILY COLLECTION AND DISPOSAL, <br />SECTION 66.028 BY ADDING A MONTHLY SERVICE FEE FOR <br />RESIDENTIAL SOLID WASTE SERVICE FOR A LARGE TRASH CART <br />CONSISTING OF A CAPACITY OF 96 GALLONS AND REDUCING THE <br />SIZE OF THE BASE -RATE TRASH CART FROM A 96 GALLON TO A 65 <br />GALLON CART; RATIFYING AN INCREASE IN THE RECYCLE DROP <br />OFF CENTER RATE; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING AN EFFECTIVE DATE <br />RECITALS: <br />1. The Municipal Solid Waste Task Force has recommended increasing waste reduction through <br />diversion. <br />2. Implementation of a smaller 65 gallon capacity base -rate trash cart instead of a 96 gallon cart <br />furthers the goal of reducing waste. <br />3. The City received a CPI contract adjustment for recycling in June 2013 which resulted in a <br />once cent per month increase in the Recycle Drop off Center rate as of July 2013. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The approved rates for Residential Solid Waste & Recycling Service, <br />Separate Residential Services, and Multi- Family Recycling Service are hereby amended to add a <br />monthly service fee in the amount of $3.00 for a Large Trash Cart with a 96 gallon capacity and <br />reducing the Base -rate Trash Cart from a 96 gallon to a 65 gallon capacity cart effective December 1, <br />2013. <br />SECTION 2. The increase in the Recycle Drop off Center rate from 71 cents to 72 cents per <br />month is hereby ratified and approved effective July 1, 2013. <br />SECTION 3. The amended matrix of rates is attached to this ordinance as Exhibit "A" is <br />hereby approved. <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br />SECTION 5.
