<br />-2- <br /> <br />2. <br /> <br />In consideration of the operation of the Aquarena <br />Springs Golf Course by Aquarena in the manner as <br />described in paragraph 1 above, the City of San <br />Marcos agrees, during the term of this agreement and <br />provided that Aquarena is not in material breach of <br />its obligations hereunder, to (i) furnish water to <br />the Aquarena Springs Golf Course at no charge (ii) <br />relinquish its claim, if any, to the cost of water <br />service provided to the Aquarena Springs Golf Course <br />from January 1, 1981 to the effective date hereof. <br /> <br />3. <br /> <br />This agreement shall be for a term of one year from <br />the effective date hereof, and shall automatically <br />be renewed for an additional one year term on each <br />anniversary date hereof unless either party gives <br />written notice to the other no less than thirty days <br />prior to the expiration of such one year term. <br />Notwithstanding the foregoing, either party to this <br />agreement may terminate this agreement at any time <br />by giving the other party written notice of such <br />termination at least thirty days prior to the date <br />of any proposed termination. <br /> <br />If you are in agreement wi th the forgoing, please sign the <br />enclosed copy of this letter and return such copy to the <br />undersigned, whereupon this letter will become a binding <br />agreement as of the date hereof. <br /> <br />JLM:ktp <br /> <br />Enclosure <br /> <br />Cordially, <br /> <br />9£fi~ <br /> <br />ACCEPTED AND AGREED TO AS <br />OF THE DATE ABOVE WRITTEN <br /> <br />Ci ty of San Marcos <br /> <br />By: <br /> <br />Name: <br /> <br />Title: <br /> <br />1'" <br /> <br />~V)¡t~ <br /> <br />Kathy M.
