<br />unavailability of ARCHITECT will result in, in CITY's opinion, harm to <br /> <br />CITY, <br /> <br />in which case instructions may be forwarded directly to the <br /> <br />Contractor by CITY. <br /> <br />The ARCHITECT shall have authority to act on <br /> <br />behalf of the CITY only to the extent provided herein and in the <br /> <br />construction contract documents unless otherwise modified by written <br /> <br />instrument in accordance with Section 1.5.13. <br /> <br />Any instructions issued <br /> <br />directly by CITY to Contractor shall be immediately communicated to <br />ARCHITECT if the ARCHITECT was unavailable at the time of issuance of <br /> <br />instructions. <br /> <br />1.5.4 <br /> <br />The ARCHITECT shall conduct a pre-construction conference <br /> <br />with the Contractor and members of CITY's staff, the Federal Aviation <br /> <br />Administration <br /> <br />(FAA) <br /> <br />and <br /> <br />the <br /> <br />U.S. <br /> <br />Department <br /> <br />of <br /> <br />Labor <br /> <br />(DOL) <br /> <br />as <br /> <br />necessary <br /> <br />and <br /> <br />shall <br /> <br />make <br /> <br />professional <br /> <br />on-site <br /> <br />inspections <br /> <br />of <br /> <br />the <br /> <br />project(s) <br /> <br />often enough to ensure familiarity with the progress and <br /> <br />quality <br /> <br />of <br /> <br />the <br /> <br />Work, <br /> <br />to <br /> <br />determine <br /> <br />if <br /> <br />the <br /> <br />Work <br /> <br />is <br /> <br />proceeding <br /> <br />in <br /> <br />acceptable conformance with the construction contract documents, and to <br /> <br />review the work with the CITY's inspector. <br /> <br />However, such inspections <br /> <br />shall not be less than twice per month. <br /> <br />On the basis of such on-site <br /> <br />professional inspections as an ARCHITECT, the ARCHITECT shall keep the <br /> <br />CITY, <br /> <br />the FAA and DOL informed of the progress and quality of the <br /> <br />Work. <br /> <br />In performing these services, the ARCHITECT will endeavor to <br /> <br />protect the CITY against defects and deficiencies in the quality and <br /> <br />quantity <br />ARCHITECT's <br /> <br />of <br /> <br />the <br /> <br />Work <br /> <br />of <br /> <br />the <br /> <br />Contractor <br /> <br />if <br /> <br />such <br /> <br />are <br /> <br />within <br /> <br />the <br /> <br />knowledge <br /> <br />or <br /> <br />should <br /> <br />reasonably <br /> <br />have <br /> <br />been <br /> <br />within <br /> <br />the <br /> <br />knowledge <br /> <br />of <br /> <br />the <br /> <br />ARCHITECT. <br /> <br />For <br /> <br />purposes <br /> <br />of <br /> <br />efficiency, <br /> <br />cost <br /> <br />effectiveness <br /> <br />and to <br /> <br />insure prompt availability of representation, <br /> <br />ARCHITECT shall employ a local, qualified individual to perform site <br />visitations, subject to CITY approval of said individual. <br /> <br />1.5.5 <br /> <br />The ARCHITECT shall not have control or charge of and shall <br /> <br />not <br /> <br />be <br /> <br />responsible <br /> <br />for <br /> <br />construction <br /> <br />means, <br /> <br />methods, <br /> <br />techniques, <br /> <br />sequenceR nr nroC"'.edures , <br /> <br />or for safety precautions and programs in <br /> <br />connection with the Work, for the acts or omissions of the Contractor, <br /> <br />Sub-contractors or any other persons performing any of the Work, or for <br /> <br />the failure of any of them to carry out the Work in accordance with the <br /> <br />construction contract documents unless such acts or omissions are due <br /> <br />-5- <br />
