ORDINANCE 2008-53 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, CANVASSING RETURNS AND DECLARING RESULTS <br />OF THE GENERAL AND SPECIAL ELECTION, HELD ON NOVEMBER 4, <br />2008, FOR THE PURPOSE OF ELECTING A MAYOR, A CITY COUNCIL <br />MEMBER, PLACE 3, A CITY COUNCIL MEMBER, PLACE 4, SUBMITTING <br />PROPOSITIONS TO THE VOTERS REGARDING CITY CHARTER <br />AMENDMENTS; SUBMITTING A NON-BINDING REFERENDUM <br />CONCERNING THE HOURS OF SERVICE FOR ON-PREMISE <br />CONSUMPTION OF ALCOHOL; AND DECLARING AN EMERGENCY. <br />RECITALS: <br />1. On August 19, 2008 the City Council ordered that a General and Special Election be held <br />on November 4, 2008 for the purpose of electing a Mayor, a City Council Member, Place 3, a <br />City Council Member, Place 4, submitting propositions to the voters regarding City Charter <br />Amendments, and submitting a non-binding referendum concerning the hours of service for on- <br />premise consumption of alcohol. <br />. 2. Notice of this election was duly published in the San Marcos Daily Record on October 16 <br />and 23, 2008. <br />3. A copy of the notice was posted on the bulletin board at City Hall on October 13, 2008. <br />4. This election was duly and legally held on November 4, 2008, in conformity with the <br />election laws of the State of Texas, and the results of the election have been certified and <br />returned by the proper judges and clerks. <br />5. The City Council of the City of San Marcos, Texas with the following members present: <br />Susan Narvaiz, Kim Porterfield, Gaylord Bose, Daniel Guerrero, Chris Jones, Pam Couch, and <br />John Thomaides have today considered the returns of the General election held on November 4, <br />2008. <br />6. It appears to the Council, and the Council finds, that the election was in all respects <br />lawfully held. <br />7. It appears to the Council, and Coun?lt finds, that the tabulation of the results of the <br />• election is correct. <br />1
