<br />87 <br /> <br />EXHIBIT "A" <br /> <br />STATE OF TEXAS <br /> <br />CONTRACT FOR SERVICES <br /> <br />COUNTY OF HAYS <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS: <br /> <br />That <br /> <br />the <br /> <br />City <br /> <br />of <br /> <br />San <br /> <br />Marcos, <br /> <br />Texas, <br /> <br />a municipal corporation <br /> <br />existing by and under the laws of the State of <br /> <br />Texas, <br /> <br />acting <br /> <br />throuGh <br /> <br />authority conferred on <br /> <br />its <br /> <br />Mayor, Kathy M. Morris, by Resolution duly <br /> <br />adopted on September 26, 1988, <br /> <br />hereina fter <br /> <br />"Ci ty, " <br /> <br />and <br /> <br />the <br /> <br />San <br /> <br />Marcos <br /> <br />Chamber of <br /> <br />Commerce, <br /> <br />hereinafter <br /> <br />"Chamber," <br /> <br />acting by and <br /> <br />through <br /> <br />its <br /> <br />President, Jesse <br /> <br />Es trada , <br /> <br />enter <br /> <br />into <br /> <br />this <br /> <br />Agreement <br /> <br />pursuant <br /> <br />to <br /> <br />the terms <br /> <br />and <br /> <br />provisions of <br /> <br />Chapter <br /> <br />26, Article <br /> <br />II, <br /> <br />of <br /> <br />the <br /> <br />Code <br /> <br />of <br /> <br />Ordinances <br /> <br />of the City of San Marcos, Texas, and <br /> <br />Chapter 351, Tax Code, V.T.C.A. <br /> <br />WITNESSETH <br /> <br />I. <br /> <br />That <br /> <br />City <br /> <br />has enacted by ordinance a hotel room occupancy tax to <br /> <br />be <br /> <br />levied <br /> <br />upon <br /> <br />the <br /> <br />occupancy <br /> <br />of any room furnished by any hotel or <br /> <br />motel within City. <br /> <br />Pursuant <br /> <br />to <br /> <br />Section <br /> <br />26-21 of <br /> <br />the <br /> <br />Code <br /> <br />of <br /> <br />Ordinances <br /> <br />of <br /> <br />Ci ty , <br /> <br />"Use <br /> <br />of <br /> <br />Proceeds", <br /> <br />City <br /> <br />does hereby agree to <br /> <br />allocate <br /> <br />funds <br /> <br />from <br /> <br />the <br /> <br />revenue <br /> <br />of <br /> <br />said <br /> <br />tax to <br /> <br />Chamber. <br /> <br />The <br /> <br />allocation <br /> <br />of <br /> <br />funds <br /> <br />to <br /> <br />Chamber <br /> <br />is <br /> <br />hereby <br /> <br />agreed <br /> <br />to <br /> <br />be <br /> <br />six-sevenths <br /> <br />( 6/7 ) <br /> <br />of <br /> <br />the gross of <br /> <br />all funds <br /> <br />collected from the <br /> <br />hotel room occupancy tax. <br /> <br />Furthermore, it is expressly <br /> <br />ag reed <br /> <br />that <br /> <br />Chamber <br /> <br />shall <br /> <br />be <br /> <br />entitled <br /> <br />to <br /> <br />operating <br /> <br />and <br /> <br />administrative <br /> <br />expenses <br /> <br />incurred <br /> <br />in <br /> <br />ful filling <br /> <br />Chamber's responsibilities <br /> <br />under <br /> <br />this <br /> <br />Ag reemen t. <br /> <br />Said <br /> <br />operating <br /> <br />and <br /> <br />administrative <br /> <br />expenses <br /> <br />shall <br /> <br />not <br /> <br />exceed <br /> <br />fifteen <br /> <br />percent <br /> <br />( 15% ) <br /> <br />of <br /> <br />the <br /> <br />tota 1 <br /> <br />allocation of such funds collected from the hotel room <br /> <br />occupancy <br /> <br />tax <br /> <br />and received by Chamber. <br /> <br />II. <br /> <br />Chamber <br /> <br />hereby agrees to expend said funds for the activities set <br /> <br />out in Section 26-21 of the Ordinance. <br /> <br />Those activities shall <br /> <br />include <br /> <br />advertising for general promotion <br /> <br />and <br /> <br />tourism <br /> <br />for <br /> <br />the <br /> <br />City of <br /> <br />San <br /> <br />Marcos <br /> <br />and <br /> <br />its <br /> <br />vicinity <br /> <br />and <br /> <br />conducting <br /> <br />a <br /> <br />solicitation <br /> <br />and <br /> <br />operating program to attract <br /> <br />conventions <br /> <br />and <br /> <br />visitors <br /> <br />to the City. <br /> <br />Chamber further agrees to make such expenditures in <br /> <br />conformance <br /> <br />with <br />
