<br />91 <br /> <br />RESOLUTION 1988-106R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, SUPPORTING THE PROPOSED CONSTITUTIONAL <br />~1ENDMENT DEDICATING FEDERAL HIGHWAY' FUNDS RECEIVED BY <br />THE STATE OF TEXAS EXCLUSIVELY FOR THE INTENDED PURPOSE <br />OF IMPROVING TEXAS HIGHWAYS AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, Texas motorists pay a federal fuel tax of 9 cents a <br />gallon into the Federal Highway Trust Fund, which is legislatively <br />mandated to be apportioned to states for use on the Federal Aid Highway <br />Program; and, <br /> <br />WHEREAS, Texas receives approximately $800 million a year from the <br />Federal Highway Trust Fund; and, <br /> <br />WHEREAS, the federal funds pay for 50-60% of highway <br />in Texas; and, <br /> <br />construction <br /> <br />WHEREAS, since 1817 when federal highway funds first became <br />available to the states, Texas has used 100% of such funds exclusively <br />for highway purposes as mandated by federal law; and, <br /> <br />WHEREAS, federal highway funds are received <br />reimbursement for the expenditure of constitutionally <br />highway user taxes; and, <br /> <br />by the s ta te as <br />dedicated state <br /> <br />WHEREAS, it has been proposed recently that federal highway funds <br />~eceived by the State of Texas as reimbursement be diverted to general <br />revenue purposes; and, <br /> <br />WHEREAS, diversion of the federal highway funds would (1) be <br />unlawful, (2) violate the public trust, and (3) destroy the <br />successful concept that those who use highways should pay for their <br />construction and maintenance; and, <br /> <br />WHEREAS, Texas voters can stop this effort to divert federal <br />highway funds to unrelated purposes by voting for a proposed GOOD ROADS <br />AMENDMENT to the state constitution which is on the ballot in the <br />November 1988 general election; and, <br /> <br />WHEREAS, this proposed constitutional amendment will appear on <br />the ballot in the following form: "The constitutional amendment and/or <br />clarification provides that federal reimbursement of state highway <br />dedicated funds are themselves dedicated for the purpose of acquiring <br />~ights-of-way and construction, maintaining, and policing public <br />roadways"; now, therefore, <br /> <br />BE <br />TEXAS: <br /> <br />IT <br /> <br />RESOLVED <br /> <br />BY <br /> <br />THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> <br />PART 1. That the City Council supports the proposed <br />constitutional amendment dedicating federal highway funds received by <br />the State of Texas exclusively for the intended purpose of improving <br />Texas highvlays. <br /> <br />PART 2. That the City Council calls on all San Marcos voters to <br />join in supporting the proposed amendment and pledge support in <br />educating the voters to the critical importance of a YES vote for the <br />GOOD ROADS N1ENDMENT. <br /> <br />PART 3.
