<br />ORDINANCE 1988-74
<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13,1984 (VOL. 66) BY
<br />ZONING BLOCK 1, LOT llA OF A REPLAT OF A PORTION OF LOTS
<br />11 AND 12, BLOCK ONE, D.P. HOPKINS ADDITION TO THE CITY OF
<br />SAN MARCOS, HAYS COUNTY, TEXAS, AS RECORDED IN VO LUME 5,
<br />PAGE 70 OF THE HAYS COUNTY PLAT RECORDS, HAYS COUNTY, TEXAS,
<br />LOCATED AT 321 S. L.B. J. DRIVE FROM "I" (INDUSTRIAL)
<br />DISTRICT TO "c" (COMMERCIAL) DISTRICT; AND DECLARING AN
<br />EFFECTI VE DATE.
<br />
<br />WHEREAS, on August 16, 1988 the Joint Planning and Zoning
<br />Commissions of the City of San Marcos held a public hearing regarding
<br />a request to change the zoning from "I" (Industrial) District to
<br />"c" (Commercial) District of Block 1, Lot 11A of a replat of a
<br />portion of Lots 11 and 12, Block One, D.P. Hopkins Addition, as recorded
<br />in Volume 5, Page 70 of the Hays County Plat Records, Hays County,
<br />Texas, to the City of San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said
<br />Zoning Commission did, on August
<br />vote to approve the same and
<br />request be approved by the
<br />City; and,
<br />
<br />public hearing on said date, said
<br />16, 1988, consider said request and
<br />has recommended that such
<br />City Council of said
<br />
<br />of
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />October, 1988, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety: now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "I" (Industrial) District be rezoned "C"
<br />(Commercial) District:
<br />
<br />BLOCK 1, LOT 11A OF A REPLAT OF A PORTION OF LOTS 11 AND 12,
<br />BLOCK ONE, D.P. HOPKINS ADDITION TO THE CITY OF SAN MARCOS,
<br />HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME 5, PAGE 70 OF THE
<br />HAYS COUNTY PLAT RECORDS, HAYS COUNTY, TEXAS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on October 24, 1988, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.
<br />
<br />PASSED, APPROVED AND ADOPTED this 10 day of
<br />subject to reconsideration at the next regular City
<br />scheduled for October 24, 1988
