<br />Mutual Modification results in additions or deletions to the <br />components of the Project, so long as the modification of the <br />utility Plan is agreed to by all parties, the modified <br />Project may be financed in compliance with this Amended <br />Agreement. <br /> <br />section 4.03. Water Transport Permit. The parties <br />acknowledge that a water transport permit from the Edwards <br />Underground Water District will be required, and the City <br />agrees to attempt to obtain it. The city agrees to retain a <br />registered and recognized groundwater hydrologist familiar <br />with such permits to perform any studies required to obtain <br />said permit. In the event the City fails to secure the water <br />transport permit, the City shall obtain water from other <br />sources to meet its obligation to provide water service to <br />the District as provided herein. <br /> <br />Section 4.04. Water SupplY, Treatment, and Distribution <br />Facilities. The first phase of the Regional Water Facilities <br />includes a well field consisting of two wells, a standpipe, <br />and transmission mains as described in Exhibit D hereto. <br />Subsequent phases will include installation of additional <br />wells, ground storage facilities, high service pumping, an <br />elevated storage tank, and additional transmission mains. <br />The facilities and the phasing reflected in Exhibit D hereto <br />are estimates and may be modified from time to time with the <br />approval of the City which may not be unreasonably withheld <br />as required by the District's development plans. The <br />District will also construct an internal water distribution <br />system required to serve the District. <br /> <br />Section 4.05. Wastewater Collection and Treatment <br />Facilities. The first phase of the Regional Wastewater <br />Facilities includes approximately 14,000 linear feet of <br />wastewater interceptor sized to meet the ultimate require- <br />ments described in the utility Plan, and a lift station and <br />force main to the City's existing wastewater treatment plant <br />as described in Exhibit D hereto. Subsequent phases will <br />include expansion of capacity within the City's regional <br />wastewater treatment plant, and upgrades of the lift station <br />and force mains. The facilities and the phasing reflected in <br />Exhibit D hereto are estimates and may be modified from time <br />to time wi th the approval of the Ci ty which may not be <br />unreasonably withheld as required by the District's develop- <br /> <br />-11- <br />
