'---- 22 ORDINANCE 1988-81 h c_j C> AN ORDI NANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING A DEVELOPMENT AGREEMENT APPROVED ON FEBRUARY 9, 1987, WHICH IS RELATED TO AN AGREEMENT AND AN AMENDED AGREEMENT GRANTING THE CONSENT OF THE CITY OF SAN MARCOS TO THE CREATION OF THE LOWMAN RANCH MUNICIPAL UTILITY DISTRICT, AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT, AND DECLARING AN EFFECTIVE DATE. WHEREAS, the Texas Water Commission's staff has reviewed that agreement approved by the City Council on February 9, 1987, granting its consent to the creation of the Lowman Ranch Municipal Utility District; and, WHEREAS, the Texas Water commission's staff has recommended certain changes to said agreement; and, WHEREAS, the Texas Water Commission's staff recommended, also, certain changes to a related development agreement; and, ~'JHEREAS, an amended development agreement has been prepared for consideration by the parties; now, therefore, BE IT ORDAINED MARCOS, TEXAS: BY THE CITY COUNCIL OF THE CITY OF SAN SECTION 1. That the terms and conditions of a proposed amended agreement pertaining to the development of Lowman Ranch Municipal Utility District between said City and the owners and developers of the property to be included in the proposed distr ict, a copy of said proposed amended development agreement being attached hereto and incorporated herein for all purposes as though recited verbatim as Attachment "A", are hereby in all things approved. SECTION 2. That the Mayor is authorized to execute said amended agreement enumerated in Section 1 above. SECTION 3. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas. PASSED AND APPROVED on first reading October 10, 1988. PASSED AND APPROVED on second reading October 17, 1988.
