<br />effect on the effective date of the deed restriction. <br />Subsequent amendments to the City's zoning and landscaping <br />ordinances shall not be considered in the City staff's review <br />and approval process. LRL agrees to submit its proposed deed <br />restrictions to the City Planning Department for review and <br />approval at the time of final plat approval on a plat by plat <br />basis. The city's review is limited to the substantive <br />(quantitative and qualitative) aspects of the deed <br />restrictions and the City may not obj ect to any procedural <br />aspects of implementation or modification. If the City <br />refuses to approve the deed restrictions, the parties agree <br />to submit them for arbitration, which process shall be paid <br />for solely by LRL. Two landplanners who hold AICP <br />designations, one selected by each party hereto shall review <br />the proposed deed restrictions. In the event the two land- <br />planners cannot agree on appropriate deed restrictions, the <br />two landplanners will mutually select a third landplanner who <br />holds an AICP designation and whose determination as to the <br />deed restrictions to apply to the property described in this <br />Amended Agreement will be binding on LRL and the city. The <br />deed restrictions thus determined will be officially recorded <br />by LRL. The parties agree these methods will have the effect <br />of assuring a high quality of construction in conformity with <br />that within the City as well as providing a warranty to <br />future property owners. <br /> <br />Section 2.02. Architectural Control. LRL agrees to <br />establish an architectural control committee (the "Commit- <br />tee"). The Committee shall review all site plans for <br />development within the District for compliance with criteria <br />duly adopted by said Committee as well as the deed restric- <br />tions described in Section 2.01 hereof. LRL agrees to <br />provide annual notice of the Committee's regularly scheduled <br />meetings, and to provide notice of the Committee's special <br />meetings three working days in advance thereof to the City <br />Secretary. <br /> <br />ARTICLE THREE <br /> <br />LAND USE RESERVATION AND DEDICATION <br /> <br />Section 3.01.
