<br />29 <br /> <br />RESOLUTION 1988-117R <br /> <br />A RESOLU'r ION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AUTHORIZING <br />SAID CITY'S ONE-YEAR PARTICIPATION IN <br />PURCHASING PROGRAMS OF THE STATE <br />PURCHASING AND GENERAL SERVICES <br />COMMISSION FOR THE ACQUISITION OF CERTAIN <br />PRODUCTS AND MATERIALS ON THE <br />COMMISSION'S ANNUAL CONTRACTS FOR SUCH <br />ITEMS, AUTHORIZING AND DIRECTING THE CITY <br />MANAGER TO SIGN AND DELIVER ALL NECESSARY <br />REQUESTS AND OTHER DOCUMENTS IN <br />CONNECTION THEREWITH, DIRECTING THAT ALL <br />DECISIONS OF THE CITY MANAGER RELATING TO <br />SAID PURCHASING PROGRAMS SHALL BE AS <br />DIRECTED BY THE CITY COUNCIL, PROVIDING <br />THAT SAID CITY WILL PURCHASE SUCH ITEMS <br />FROM THE CONTRACTS MADE PURSUANT TO THIS <br />RESOLUTION BY SUBCHAPTER D, SECTIONS <br />271.Ø81-271.Ø83 , VERNON'S ANNOTATED <br />TEXAS LOCAL GOVERNMENT CODE, EXCEPT IN <br />EMERGENCIES, AND THAT SAID CITY WILL BE <br />RESPONSIBLE FOR PAYMENT DIRECTLY TO THE <br />VENDOR UNDER EACH SUCH CONTRACT AND WILL <br />BE RESPONSIBLE FOR THE VENDOR'S <br />COMPLIANCE WITH ALL CONDITIONS OF <br />DELIVERY AND QUALITY OF PURCHASED ITEMS, <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the Ci ty of San Marcos, Texas pur suant to the <br />authority granted by Subchapter D, Sections 271.081-271.Ø83, <br />Vernon I s Annotated Texas Local Government Code, as amended, <br />desires to participate in certain below-described purchasing <br />programs of the State Purchasing and General Services <br />Commission; and <br /> <br />WHEREAS, the City Council of said City is of the opinion <br />that participation in these programs will be highly <br />beneficial to the taxpayers of this City through the <br />anticipated savings to be realized; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. That the City of San Marcos, Texas, does hereby <br />request the State Purchasing and General Services Commission <br />to include said City's stated need for Contract Class No. <br />Ø7Ø, Automobiles and Light Duty Trucks, Contract Class No. <br />863, Tires and Tubes, Contract Class No. 2Ø5, Computers and <br />Equipment, Contract Class No. 208, IBM Computers, Contract <br />Class No. 2Ø9, Apple Computers, Contract Class No. 203, Laser <br />Printers, Contract Class No. 575, Microfiche, Microfilm <br />Equipment and Supplies, and Contract Class No. 515, Lawn <br />Equipment on the Commission's annual contract for those <br />items, whereby the City may be allowed to purchase those <br />items from said annual contracts. <br /> <br />PART 2. That said City's participation in such <br />purchasing programs of the State Purchasing and General <br />Services Commission for the acquisition of such items is <br />hereby authorized. <br /> <br />PART 3. That the City Manager is hereby authorized and <br />directed to sign and deliver all necessary requests and other <br />documents in connection therewi th for and on behal f of said <br />City. <br /> <br />PART 4. That all decisions of said City Manager <br />relating to said purchasing programs will be directed by the <br />City Council. <br />
