<br />B. Department shall not be liable to Contractor for any costs incurred by <br />Contractor under this contract until Department receives a properly <br />completed Depository/Authorized Signators Form, as specified by Department, <br />from Contractor. <br /> <br />C. Contractor shall obligate all funds provided under this contract by <br />December 27, 1988, and Department shall recapture any funds not so <br />obligated. Department shall consider such funds obligated if Contractor has <br />plated orders, awarded contracts, received services, or entered similar <br />transactions that require payment from funds awarded under this contract. <br /> <br />D. Contractor shall ensure that any building assisted with funds provided <br />under this contract is maintained as a shelter for the homeless for not less <br />than a three-year period, or for not less than a ten-year period if such <br />funds are used for major rehabilitation or conversion of the building. The <br />applicable period shall be calculated in accordance with 24 CFR Section <br />575.53(b) (52 Fed. Reg. 38873 (October 19,1987).) <br /> <br />E. Contractor shall ensure that activities performed under this contract <br />shall be carried on in a manner free from religious influence. Contractor <br />shall execute an agreement with any primarily religious organization <br />receiving funds provided under this contract from Contractor which includes <br />provisions, as provided by Department, to effectuate such assurance. <br />Contractor shall submit such agreement to Department prior to the release of <br />funds provided under this contract. <br /> <br />SECTION 22. <br /> <br />ORAL AND WRITTEN AGREEMENTS <br /> <br />A. All oral and written agreements between the parties to this contract <br />relating to the subject matter of this contract that were made prior to the <br />execution of this contract have been reduced to writing and are contained in <br />this contract. <br /> <br />B.
