<br /> <br />ð <br />c::> <br /> <br /> <br />BE <br /> <br />48 <br /> <br />ORDINANCE 1988-86 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING DIVISION 2 OF ARTICLE III OF <br />CHAPTER 2 OF THE CODE OF ORDINANCES OF SAID CITY BY <br />CHANGING SECTION 2-37(B) TO DELETE THE MANDATORY <br />AGE REQUIREMENT OF 50 YEARS FOR RETIREMENT UPON <br />COMPLETION OF 25 YEARS CREDITED SERVICE, ADDING <br />SECTION 2-50, SURVIVOR BENEFITS, ADDING SECTION <br />2-51, OPTIONAL DISABILITY RETIREMENT BENEFITS, <br />AMENDING OUTDATED CITATIONS TO WRITTEN LEGAL <br />AUTHORITIES, AMENDING THE DELEGATION OF AUTHORITY <br />TO THE CITY SECRETARY TO CARRY OUT CERTAIN FINANCIAL <br />DUTIES TO THE DIRECTOR OF THE FINANCE DEPARTMENT, <br />AMENDING SECTION 2-43 TO CHANGE THE DATE ON WHICH <br />CALCULATIONS OF UPDATED SERVICE CREDITS ARE BASED <br />AND TO CHANGE THE DATE ON WHICH CALCULATIONS OF <br />UPDATED SERVICE CREDITS ARE BASED FOR MEMBERS WITH <br />UNFORFEITED PRIOR AND/OR CURRENT SERVICE CREDIT WITH <br />OTHER PARTICIPATING MUNICIPALITIES, AMENDING SECTION <br />2-44(B) TO CHANGE THE DATE ON WHICH CALCULATIONS OF <br />RETIREMENT ANNUITY INCREASES ARE BASED, AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />IT <br /> <br />ORDAINED <br /> <br />BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That Section 2-37(b) of Division 2 of Article III of <br />Chapter 2 of the Code of Ordinances of said city is hereby amended to <br />read as follows: <br /> <br />Chapter 2 <br /> <br />ADMINISTRATION <br /> <br />. . . <br /> <br />ARTICLE III. CIVIL SERVICE AND EMPLOYEE BENEFITS <br /> <br />DI VI SION 2. <br /> <br />TEXAS MUNICIPAL RETIREMENT SYSTEM <br /> <br />. . . <br /> <br />Sec. 2-37. <br /> <br />Employees included. <br /> <br />. . . <br /> <br />(b) After one year from the effective date of <br />membership, any member who has completed twenty-five (25) <br />years of creditable service with this city or who has <br />attained the age of sixty (60) years and has <br />completed at least ten (10) years of creditable service <br />with participating municipalities which have adopted the <br />plan provisions of this section, or who has become <br />eligible for service retirement under any other applicable <br />provision of Subtitle G of Title 110B, V.A.C.S., shall be <br />eligible for service retirement. <br /> <br />SECTION 2.
