<br />55 <br /> <br />AMENDMENT NO. 01 <br />TEXAS RENTAL REHABILITATION PROGRAM <br />TCOP CONTRACT NO. 456218 <br />TEXAS DEPARTMENT OF Cor'1MERCE <br />AND <br />CITY OF SAN t1ARCOS <br /> <br />STATE OF TEXAS] <br />COUNTY OF TRAVIS] <br /> <br />Section 1. <br /> <br />The Texas Department of Commerce, an agency of the State of Texas, hereinafter <br />referred to as IIDepartmentll, and the City of San Marcos, hereinafter referred <br />to as "Contractor", do hereby contract and agree to amend their original <br />contract, as initially executed by the Executive Director of Department <br />effecti ve February 1, 1987, through September 30, 1988, for the performance of <br />rental rehabilitation activities. <br /> <br />Section 2. <br /> <br />The parties hereto agree to amend the contract identified in Section 1 above <br />by deleting Section 4 Subsection C, Limit of Liability in its entirety and <br />replacing it with the following: <br /> <br />C. <br /> <br />LIMIT OF LIABILITY <br /> <br />Notwithstanding any other provision of this contract, the total of all <br />amounts obligated by Department under this contract shall not exceed the <br />sum of Five Thousand and No/100 Dollars ($5,000.00). <br /> <br />Section 3. <br /> <br />The parties hereto agree that this amendment shall become effective on <br />September 2,1988. <br /> <br />Section 4. <br /> <br />The parties hereto agree that all of the terms of the contract identified in <br />Section 1 above shall remain in effect and shall continue to govern except to <br />the extent that they conflict with the terms of this amendment. <br /> <br />Section 5. <br /> <br />The parties hereto agree that nothing in this amendment shall be construed as <br />authorizing any violation of federal, state or local laws or regulations as <br />they pertain to the contract identified in Section 1 above. <br /> <br />PAGE 1 OF 2 <br />
