<br />-6- <br /> <br />ARTICLE II. <br /> <br />ABANDONED PROPERTY <br /> <br />. . . <br /> <br />01 VI SION 4. <br /> <br />JUNKED VEHIC LES <br /> <br />Sec. 16-41. <br /> <br />Junked vehicles declared public nuisance. <br /> <br />A junked vehicle that is located in a place where it is <br />visible from a public place or public right-of-way is <br />detrimental to the safety and welfare of the general <br />public, tends to reduce the value of private property, <br />invites vandalism, creates fire hazards and constitutes <br />an attractive nuisance creating a hazard to the health and <br />safety of minors, and is detrimental to the economic <br />welfare of the City by producing urban blight adverse to <br />the maintenance and continuing development of the City, <br />and is a public nuisance. <br /> <br />Sec. 16-43. <br /> <br />Junked vehicles on streets or highways prohibited. <br /> <br />No person shall leave a junked vehicle on any street or <br />highway within the City under such circumstances as to cause <br />such junked vehicle reasonably to appear to have been <br />abandoned, and, under no circumstances, for longer than <br />forty-eight (48) consecutive hours. <br /> <br />Sec. 16-44. <br /> <br />Junked <br /> <br />vehicles on <br /> <br />private <br /> <br />property <br /> <br />prohibited. <br /> <br />No person in charge of or in control of any property within <br />the City, whether as owner, tenant, occupant, lessee or <br />otherwise, shall allow any junked vehicle to remain on such <br />property for longer than forty-eight (48) consecutive hours, and <br />no person shall leave any junked vehicle on private property <br />not belonging to him/her or on private property over which <br />he/she has no control for longer than forty-eight (48) <br />consecutive hours, except as allowed by Section 16-45 below. <br />Nothing in this Article shall be construed to allow a person to <br />leave a junked vehicle on private property over which he/she has <br />no control for any period of time without the permission of the <br />person owning, in charge of, or having control over such <br />private property. <br /> <br />Sec. 16-45. <br /> <br />Exceptions. <br /> <br />The provisions of Section 16-44 shall not apply to a junked <br />vehicle or vehicle part that is completely enclosed within a <br />building in a lawful manner where it is not visible from the <br />street or other public or private property, a vehicle or vehicle <br />part that is stored or parked in a lawful manner on private <br />property in connection with the business of a licensed vehicle <br />dealer or junkyard, or an unlicensed, operable, or inoperable <br />antique or special interest vehicle stored by a collector on the <br />collector's property, if the vehicle and the outdoor storage <br />area are maintained in a manner so that they do not constitute a <br />health hazard and are screened from ordinary public view by <br />means of a fence, trees, shrubbery, or other appropriate means, <br />or a vehicle which is completely covered by a commercially <br />available car cover in such a manner that no part of the vehicle <br />except the tires is exposed to public view, or a vehicle in an <br />appropriate storage place or depository maintained in a lawful <br />manner by the City or approved by the City. <br /> <br />Sec. 16-46. <br /> <br />Hardship appeal. <br /> <br />Any requirement of this Division which results or will result <br />in undue financial hardship to any person may be appealed by <br />that person to the Zoning Commission. In deciding an appeal <br />under this section, the Zoning Commission shall consider the <br />following items in determining whether or not to grant the <br />appellant any relief from the terms and conditions of this <br />Division: <br />
