<br />90 <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />MUTUAL TEXAS PUBLIC POWER <br />ASSOCIATION MUTUAL AID AGREEMENT <br /> <br />this <br /> <br />Texas <br /> <br />This <br /> <br />Public <br /> <br />Texas <br /> <br />Power Association ~utua1 Aid Agreement, dated <br /> <br />13 <br /> <br />day of <br /> <br />the <br /> <br />, 1 9 B 8, by <br /> <br />December <br /> <br />and <br /> <br />between <br /> <br />Public <br /> <br />Power <br /> <br />Association <br /> <br />and the City of San Marcos, Texas, a <br /> <br />municipal corproation located in Hays and Caldwell Counties, acting <br /> <br />and <br /> <br />12 <br /> <br />by <br /> <br />through <br /> <br />its <br /> <br />duly authorized officers under Resolution passed the <br /> <br />day of <br /> <br />December <br /> <br />1988, <br /> <br />is to <br /> <br />become <br /> <br />effective <br /> <br />when <br /> <br />, <br /> <br />fully executed by both parties. <br /> <br />ARTICLE I. <br /> <br />PURPOSE <br /> <br />The <br /> <br />Texas <br /> <br />Public <br /> <br />Power <br /> <br />Association <br /> <br />~u tua 1 <br /> <br />Aid <br /> <br />Program <br /> <br />is <br /> <br />established <br /> <br />to <br /> <br />provide <br /> <br />a method whereby electric utilities sutaining <br /> <br />physical damage from natural disasters can obtain emergency assistance, <br /> <br />in the form of personnel, equipment, and materials from other <br /> <br />utilities. <br /> <br />program. <br /> <br />electric <br /> <br />The purpose of this Agreement is to formally document such <br /> <br />ARTIC LE I I. <br /> <br />DEFINITIONS <br /> <br />A. <br /> <br />AGREEMENT:- The Texas Public Power Association Mutual Aid <br />Agreement. The oriqina1 Agreement and all signatory pages <br />shall be kept at the Texas Public Power Association Office in <br />Austin, Texas. A copy of the fully executed agreement is as <br />valid as the agreement itself. <br /> <br />B. <br /> <br />PARTICIPATING UTILITY- Any <br />this Mutual Aid Agreement. <br /> <br />electric utility which <br /> <br />executes <br /> <br />C. <br /> <br />DAMAGED UTILITY- Any participating utility which sustains <br />physical damage to its electrical system due to a natural <br />disaster and seeks assistance pursuant to this Agreement. <br /> <br />D. <br /> <br />ASSISTING UTIUTY- Any participating utility which agrees <br />provide assistance to a damaged utility pursuant to this <br />Ag reemen t . <br /> <br />to <br /> <br />E. <br /> <br />AUTHORIZED REPRFSENTATIVE- An employee of a participating <br />utility authorized by that utility to request or offer <br />assistance under the terms of this Agreement. (A list of the <br />authorized representatives for each participating utility <br />shall be attached to this Agreement as Appendix A). <br /> <br />F. <br /> <br />PERIOD OF ASSISTANCE- The period of time beginning with the <br />departure of any personnel of the assisting utility from any <br />point for the purpose of traveling to the damage utility in <br />order to provide assistance and ending upon the return of all <br />personnel of the assistinq utility, after providing the <br />assistance requested to their place of work. <br /> <br />G. <br /> <br />WORK OR WORK-RELATED PERIOD- Any period of time in which <br />either the personnel or equipment of the assisting utility are <br />being used by the damaged utility to provide assistance shall <br />include travel time to and from the job. Specifically <br />included within such period of time are rest breaks when the <br />personnel of the assisting utility will return to active work <br />within a reasonable time. Specifically excluded within such <br />period of time are breakfast, lunch, and dinner. <br />
