~ C...) l.u 0 co m ~ ~ ~ 0: 1'<\ - 4 ORDINANCE 1988-97 AN ORDINANCE OF 'rHE CITY COUNCIL OF 'rHE CI'l"Y OF SAN MARCOS, TEXAS AMENDING APPENDIX A-GENERAL ZONING ORDINANCE OF THE CODE OF ORDINANCES OF SAID CITY BY MODIFYING THE DEFINITION OF HOME OCCUPATION; DELETING THE DEFINITION OF PLANNED UNIT DEVELOPMENT; RENUMBERING THE REMAINING DEFINITIONS; CLARIFYING THE APPLICATION PROCESS FOR MASTER PLAN LAND USE MmNDMENTS; ADDING "C" cmlÌ'îERCIAL DISTRICT USE AS A SPECIFIC USE TO LIGHT INDUSTRIAL DISTRICTS; ADDING "LI" LIGHT INDUSTRIAL DISTRICT USES TO INDUSTRIAL DISTRICTS; ADDING THE CONDITION THAT A SPECIFIC USE MUST BE CONSISTENT WITH THE POLICIES OF THE MASTER PLAN; CLARIFYING THE CONDITIONS ON A SPECIFIC USE PERMIT; ADDING CONDITIONS TO OFF-STREET PARKING REQUIREMENTS IN THE CENTRAL BUSINESS AREA, AND FOR RESIDENCE HALLS, :tRATERNI'l'Y AND SORORITY BUILDINGS; DELETING EXCESS LANGUAGE DESCRIBING THE CENTRAL BUSINESS DISTRICT FOR OFF-STREET PARKING REQUIREMENTS; DELETING A CROSS-REFERENCE IN NONCONFORMING LOTS; ADDING AN ADDITIONAL CONDITION FOR A ZONING VARIANCE REQUEST TO THE ZONING BOARD OF ADJUSTrmNTS; ADDING AND AMENDING DEFINITIONS; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: ~'mEREAS, on April 5, 1988, the Zoning Commission of the City of San Harcos held a pub1 ic hear ing to consider amendments to the following sections of Appendix A General Zoning Ordinance: Section 4 (48), definition of home occupation; Section -4 (73), definition of planned unit development; Section 5(d), conformance to master plan; Section 35(E), conditions on approval of specific use permits; Section 37, standards for off-street parking; Section 4Ø(c) (3), zoning variances; and, \\THEREAS, subsequen t to sa id publ ic hear i ng on sa id date, sa id commission did, on April 5,1988, consider said amendments and the Zoning Commission voted to approve the same and has recommended that said request be approved by th\3 City Council of said City; and, WHEREAS, on June 7, 1988, the Zoning Commission of the City of San Marcos held a public hearing to consider amendments to the following sections of Appendix A General Zoning Ordinance: Section 37 (A) (6), off-street parking for fraternities and sororities; Section 32(C}, commercial as specific uses in light industrial districts; Section 33(A), light industrial permitted in industrial; and, \'JHEREAS, subsequent to said public hearing on said date, said Commission did, on June 7, 1988, consider said amendments and the zoning Commission voted to approve the same and has recommended that said request be approved by the City Council of said City; and, ~VHEREAS, said City Council held a public hearing on th\3 28th day of November, 1987, regarding said amendments; and, ít\lHEREAS, said City Council hereby finds and determines that the adoption of the followin9 amendments are in the interest of the public health, morals, welfare and safety: now, therefore, PART 1.
