<br /> <br /> <br /> <br />~ <br /> <br />C...) <br />l.u <br />0 <br /> <br />co <br />m <br />~ <br />~ <br />~ <br /> <br /> <br />0: <br />1'<\ <br /> <br /> <br /> <br /> <br />- <br /> <br /> <br />4 <br /> <br />ORDINANCE 1988-97 <br /> <br />AN ORDINANCE OF 'rHE CITY COUNCIL OF 'rHE CI'l"Y <br />OF SAN MARCOS, TEXAS AMENDING APPENDIX <br />A-GENERAL ZONING ORDINANCE OF THE CODE OF <br />ORDINANCES OF SAID CITY BY MODIFYING THE <br />DEFINITION OF HOME OCCUPATION; DELETING THE <br />DEFINITION OF PLANNED UNIT DEVELOPMENT; <br />RENUMBERING THE REMAINING DEFINITIONS; <br />CLARIFYING THE APPLICATION PROCESS FOR MASTER <br />PLAN LAND USE MmNDMENTS; ADDING "C" <br />cmlÌ'îERCIAL DISTRICT USE AS A SPECIFIC USE TO <br />LIGHT INDUSTRIAL DISTRICTS; ADDING "LI" LIGHT <br />INDUSTRIAL DISTRICT USES TO INDUSTRIAL <br />DISTRICTS; ADDING THE CONDITION THAT A <br />SPECIFIC USE MUST BE CONSISTENT WITH THE <br />POLICIES OF THE MASTER PLAN; CLARIFYING THE <br />CONDITIONS ON A SPECIFIC USE PERMIT; ADDING <br />CONDITIONS TO OFF-STREET PARKING REQUIREMENTS <br />IN THE CENTRAL BUSINESS AREA, AND FOR <br />RESIDENCE HALLS, :tRATERNI'l'Y AND SORORITY <br />BUILDINGS; DELETING EXCESS LANGUAGE DESCRIBING <br />THE CENTRAL BUSINESS DISTRICT FOR OFF-STREET <br />PARKING REQUIREMENTS; DELETING A <br />CROSS-REFERENCE IN NONCONFORMING LOTS; ADDING <br />AN ADDITIONAL CONDITION FOR A ZONING VARIANCE <br />REQUEST TO THE ZONING BOARD OF ADJUSTrmNTS; <br />ADDING AND AMENDING DEFINITIONS; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />~'mEREAS, on April 5, 1988, the Zoning Commission of the City of <br />San Harcos held a pub1 ic hear ing to consider amendments to the <br />following sections of Appendix A General Zoning Ordinance: <br />Section 4 (48), definition of home occupation; Section -4 (73), <br />definition of planned unit development; Section 5(d), conformance <br />to master plan; Section 35(E), conditions on approval of specific <br />use permits; Section 37, standards for off-street parking; Section <br />4Ø(c) (3), zoning variances; and, <br /> <br />\\THEREAS, subsequen t to sa id publ ic hear i ng on sa id date, sa id <br />commission did, on April 5,1988, consider said amendments and the <br />Zoning Commission voted to approve the same and has recommended <br />that said request be approved by th\3 City Council of said City; <br />and, <br /> <br />WHEREAS, on June 7, 1988, the Zoning Commission of the City of San <br />Marcos held a public hearing to consider amendments to the <br />following sections of Appendix A General Zoning Ordinance: <br />Section 37 (A) (6), off-street parking for fraternities and <br />sororities; Section 32(C}, commercial as specific uses in light <br />industrial districts; Section 33(A), light industrial permitted in <br />industrial; and, <br /> <br />\'JHEREAS, subsequent to said public hearing on said date, said <br />Commission did, on June 7, 1988, consider said amendments and the <br />zoning Commission voted to approve the same and has recommended <br />that said request be approved by the City Council of said City; <br />and, <br /> <br />~VHEREAS, said City Council held a public hearing on th\3 28th day <br />of November, 1987, regarding said amendments; and, <br /> <br />ít\lHEREAS, said City Council hereby finds and determines that the <br />adoption of the followin9 amendments are in the interest of the <br />public health, morals, welfare and safety: now, therefore, <br /> <br />PART 1.
