<br />j,¡Q <br />~ <br /> <br /> <br />47 <br /> <br /> <br />ORDINANCE 1987-7 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE GENERAL ZONING ORDINANCE OF <br />THE SAN MARCOS CODE OF ORDINANCE BY CLARIFYING SECTION <br />2(D)(2) AND BY ADDING SECTION 2(D)(3) TO PROVIDE FOR <br />ZONING COMMISSION CONSIDERATION OF ALTERNATIVE ZONING <br />DESIGNATIONS AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />TEXAS: <br /> <br />SECTION 1: That Section 2(D)(2) of the General <br />of the San Marcos Code of Ordinances is repealed. <br /> <br />Zoning Ordinance <br /> <br />SECTION 2: That new <br />Zoning Ordinance of the <br />read as follows: <br /> <br />Sections 2(D)(2) and (3) of the General <br />San Marcos Code of Ordinances are adopted to <br /> <br />(2) A vote of 3/4 of all the members of the legislative body of <br />the City of San Marcos is required to overrule any <br />recommendation of the Zoning Commission regarding a <br />proposed amendment, supplement or change. <br /> <br />(3) The legislative body may vote only on a specific proposed <br />amendment, supplement or change that has been recommended <br />for approval or denial by the Zoning Commission. If the <br />legislative body wants to consider a zoning designation <br />other than that recommended by the Zoning Commission, <br />it shall return the zoning case to the Zoning Commission <br />with direction to make a recommendation on the alternate <br />designation suggested by the legislative body. <br /> <br />SECTION 3. That this Ordinance shall be in effect ten (10) days <br />from and after its passage, and it shall be published in a newspaper of <br />general circulation in the area as required by the Charter of the City <br />of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading <br /> <br />December 8, 1986. <br /> <br />PASSED AND APPROVED on second reading December 15, 1986. <br /> <br />PASSED, APPROVED AND ADOPTED <br /> <br />Janua~. \.1. 9.~7. <br />~ ,: Aj 6\-----. <br /> <br />E.
